How Do I Get Compensated For A Naples Taxi Cab Accident?
Because Florida is a no-fault state, injured parties generally file claims with their own personal injury protection (PIP) insurance after a car accident. According to the Florida Department of Highway Safety and Motor Vehicles, all drivers in the state must have at least $10,000 in PIP coverage.
However, you may need to turn to other avenues of compensation if:
- You don’t have PIP coverage
- Your PIP coverage does not cover all your losses
- You suffered serious injuries in the taxi cab accident
In these situations, you may be able to seek compensation from the at-fault party, such as the taxi cab company, via a personal injury claim or lawsuit. A Naples car accident attorney from our firm can file your claim or suit for you and negotiate your settlement or verdict. Your lawyer will pursue such damages as:
- Physical pain and suffering
- Mental anguish and emotional trauma
- Physical impairment or disability
- Current and future medical bills
- Vehicle repair bills, if applicable
- Other personal property bills
- Lost income
- Loss of income-earning capability
- Wrongful death damages if you lost a family member in the accident
Recovering Your Due Compensation
To ensure you seek compensation for all your losses, your Naples taxi accident lawyer must valuate your damages properly. While it’s easy to determine the value of your financial damages, it is much more difficult to determine the value of the financial damages you may incur in the future, as well as non-financial damages, like pain and suffering.
Your Naples taxi cab accident attorney can valuate your damages properly. They will use a method that the insurance company or a judge will likely recognize and approve of. This valuation may help you recover a fair amount for your damages.
Who Is Liable For A Naples Taxi Cab Accident?
Before you can receive compensation, you’ll have to identify and establish the party liable for compensating you. One of our firm’s Naples taxi accident lawyers can do this for you.
To identify the liable party, your lawyer will collect evidence of liability. This could include traffic camera footage of the accident, information from the taxi’s event data recorder, and other evidence. Your lawyer may also seek corroborating evidence, such as testimony from a car accident reconstructionist. To establish liability, your lawyer must show how the other party was negligent. Your lawyer will aim to prove:
- The other party owed you a duty of care, such as the responsibility to drive carefully
- The other party breached their duty, such as by violating a traffic law
- The breach of duty led to the accident
- The accident resulted in damages
In your case, if the driver is an employee of a cab company, the company may be liable for compensating you. However, if the driver operates independently, they may be personally liable. Either way, your lawyer can help you seek compensation through the liable party’s insurance company.

How Do I Prove My Naples Taxi Cab Accident Damages?
Proving your damages after a Naples taxi cab accident is another thing your lawyer can do for you. For example, they can obtain bills to prove your financial damages. Your lawyer could even refer you to a medical professional who can provide proof of your medical damages.
Additionally, the damage valuation your lawyer provides will help establish the legitimacy of your damages with the insurer or judge.
How Will My Naples Taxi Cab Accident Lawyer Recover My Damages?
Your Naples taxi cab accident attorney will negotiate with the other party’s insurer to reach a fair settlement. You can expect your lawyer to defend your damages, their valuation, and the evidence against the other party. If the insurer refuses to settle your case fairly, your lawyer can file a lawsuit.
Even after filing a lawsuit, your lawyer can still attempt to negotiate with the insurer to avoid a trial. However, if your case goes to court, you can expect your lawyer to fight hard for a fair verdict.
