How A Fort Myers Wrongful Death Lawyer Can Help Your Family
Losing a loved one due to someone else’s negligence is devastating, and pursuing a wrongful death claim can feel overwhelming. A wrongful death lawyer can guide you through the legal process with care and clarity, helping to relieve some of the burden during this difficult time.
Here’s how we can help:
- Accurately File Your Claim: Wrongful death claims involve strict deadlines and complex paperwork. An attorney ensures everything is filed correctly and on time, protecting your case from procedural errors that could delay or jeopardize your recovery.
- Investigate the Cause of Death: We collaborate with medical experts and investigators to determine the circumstances surrounding the incident and the underlying causes. For example, in medical malpractice cases, this may involve reviewing records, consulting with physicians, and identifying breaches in the standard of care.
- Identify All Liable Parties: Sometimes more than one party is responsible, for example, a negligent surgeon and the hospital that employed them. We examine the full picture to make sure no responsible party is overlooked.
- Handle Communications and Negotiations: Dealing with insurance companies or defense attorneys can be emotionally taxing. We handle all communication on your behalf and negotiate for a settlement that reflects the full extent of your loss.
- Pursue Fair Compensation: This includes damages for medical bills, funeral expenses, lost income, emotional suffering, and more. We work to ensure your family’s financial needs are acknowledged and met.
- Represent You in Court if Necessary: If a fair settlement cannot be reached, we are prepared to take your case to trial and advocate on your behalf before a judge or jury.
Having a wrongful death attorney on your side can make a difference in both the outcome of your case and your ability to focus on healing.
Potential Compensation For Families Filing Wrongful Death Cases
Families who lose a loved one suddenly are often unprepared for the financial burdens that follow. In addition to funeral costs, they may also face the loss of income that their loved one once provided. Our Fort Myers wrongful death attorneys can seek compensation for these and other related losses.
When you work with us, we will pursue fair compensation for damages such as:
- Medical expenses incurred by your loved one
- Pain and suffering your loved one experienced
- Lost wages if you took time off work to care for them
- Loss of inheritance due to your loved one’s income
- Funeral expenses
- Cremation or burial costs
- Loss of consortium for the companionship your loved one provided
Under Florida Statutes § 95.11(4)(d), you generally have two years from your loved one’s passing to file a wrongful death lawsuit. We can help you meet this deadline as long as you call us soon enough.

We Can Help Demonstrate Negligence In Your Fort Myers Wrongful Death Case
We represent families who lost a loved one in various accidents. Regardless of what led to your loved one’s fatal injuries, our wrongful death lawyers can help gather evidence of someone else’s negligence and hold them accountable.
We will work to illustrate the following four elements in your case:
- Someone owed your loved one a duty of care.
- They breached that duty through some act of negligence.
- Their negligence caused your loved one’s accident.
- Your loved one suffered fatal injuries due to the accident.
Sometimes, there are multiple liable parties in a wrongful death case. We can work to identify who caused or contributed to your loved one’s accident. The following parties may have shared fault for your loved one’s accident:
A Negligent Motorist
Another motorist may have caused your loved one’s fatal Fort Myers car accident. We can file an insurance claim with their provider to seek compensation.
In some car accident cases, a driver’s employer may also be liable, or a third party, such as the municipality that oversees the road, may be liable. For example, if your loved one’s accident resulted from a defective road design, we can seek compensation from the government.
A Negligent Medical Practitioner
A negligent medical practitioner may have caused your loved one’s death through a preventable error or oversight. We can pursue a claim against the responsible provider or facility to seek compensation.
In some medical malpractice cases, liability may also extend beyond the individual doctor or nurse to include hospital administration or other entities.
For example, if your loved one’s death resulted from inadequate staffing, poor sanitation, or a failure to follow proper protocols, our Fort Myers medical malpractice lawyers may be able to hold the hospital or healthcare system accountable.
A Negligent Property Owner
If your loved one slipped and fell on someone’s property, they may be liable. If a property owner fails to remove hazards, even ones they should have known about, our premises liability lawyers can build a case against them.
What Evidence Can Help Us Prove Negligence?
To build a strong wrongful death case, we must show that someone else’s negligent actions directly caused your loved one’s passing.
This often requires gathering detailed and reliable evidence. Our team will conduct a thorough investigation to uncover the facts and hold the responsible party accountable.
Some types of evidence that may help us prove negligence include:
- Eyewitness Statements: Testimony from people who saw what happened can provide valuable insight into how the incident unfolded and who may be at fault.
- Surveillance Footage: Video from traffic cameras, hospital security systems, or nearby businesses can offer clear, time-stamped visuals of the negligent act, such as a medical error or a fatal accident.
- Expert Testimony: In complex cases, we may consult specialists such as accident reconstructionists. In medical malpractice cases, Florida requires the testimony of a medical expert who can explain how standard procedures were violated or how an error led to a tragic outcome.
- Official Records and Documentation: Police reports, hospital charts, autopsy reports, maintenance logs, phone records, and other documents can help establish a timeline, reveal prior issues or negligence, and support your claim with factual detail.

What To Do After A Wrongful Death To Protect Your Legal Rights
After losing a loved one to medical negligence, legal steps may be hard to consider. However, certain actions can help protect your rights and strengthen your wrongful death case.
Whether the loss was from a motor vehicle accident, slip and fall, misdiagnosis, or medication mistake, these steps can help protect your claim:
- Preserve medical records and documents. These records can detail a loved one’s medical needs and hardships before their passing. Medical records are especially important in medical malpractice claims, as these can show what went wrong and when. Request copies of your loved one’s medical records right away. Include charts, prescriptions, test results, and discharge summaries.
- Document everything. Keep track of police reports, contact info for witnesses, and any communications with involved parties. For medical malpractice cases, keep a list of treatments, staff involved, and your loved one’s symptoms or concerns. Take notes on conversations with doctors or nurses.
- Obtain the death certificate and autopsy, if needed. The cause of death on these forms may support your claim. If things are unclear, consider asking for a private autopsy to check for medical malpractice.
- Avoid speaking to involved parties without a lawyer. Insurance companies, negligent drivers, hospital staff, and anyone else involved may want to limit their liability. Talk to a wrongful death attorney before signing forms or making statements.
- Keep track of all expenses, including medical bills, funeral costs, and lost income. These records can support your claim for compensation.
While these steps cannot bring back your loved one, they can help you seek justice and secure the financial support your family needs.
