Insurance Companies do Not Always Serve Your Best Interests
An insurance company operates as a business. It will always seek to protect its financial interest, which may not align with what is best for you.
Our lawyers can manage all communications and negotiations with the insurers. This way, your rights are protected as we are aware of the many tactics that can be used to delay or reduce your settlement.
We will also examine every possible source from which to seek compensation, such as:
- Your personal injury protection (PIP), up to a limit
- The at-fault driver
- Third-party liability (a bar owner who supplied the alcohol, for example)
- Florida’s Crimes Compensation Trust Fund
Our Contingency-Fee Arrangement
Our lawyers believe everyone should have access to legal representation and provide our legal service on a contingency-fee or no win, no fee basis. This means there are no upfront or hidden fees for you to pay.
We take on the financial risk and fund the cost of building and pursuing your case. Our fees and expenses are only taken having achieved a favorable settlement or verdict on your behalf.

Take Action in Line with the Florida DUI Accident Statute of Limitations
In Florida, a DUI accident lawsuit must be filed within a specific time. Per Florida Statutes § 95.11(3)(a), injured parties generally have four years to file a personal injury lawsuit. If the accident caused the death of a loved one, the statute of limitations for filing a wrongful death lawsuit is typically two years.
Discussing the circumstances of your accident while they are still fresh in your mind and taking effective action early on can be beneficial to your claim. It also enables your attorney enough time to gather and preserve evidence.
Steps to Take If You’ve Been Injured by a Drunk Driver
If you suspect that a drunk driver has hit you or someone you love, your next steps are critical to your health and securing compensation.
Call the Police
Report the accident immediately. Be sure to report any erratic behavior or reckless driving that you witnessed. The responding officer can conduct a sobriety test at the scene of the crash or shortly after. Per Florida Highway Safety and Motor Vehicles (FLHSMV), operating a vehicle with a blood-alcohol level of 0.08 or higher is unlawful. This information will be documented in the police report and serve as evidence in your case.
Get Medical Care
If an ambulance is dispatched to the scene, they will offer to take you to the hospital to assess your injuries. If not, seek medical attention right away. Often, the extent of injuries may not be apparent right away. Additionally, these medical records can be a key link between your injuries and the accident.
Document All Evidence
Take photos of the accident scene and your injuries if possible. Obtain contact information from any witnesses.
Avoid Giving Too Much Information to Third Parties
Statements of guilt and uncertainty after a car accident can be used against you. Protect yourself by not giving too much information to third parties or making self-jeopardizing statements.
Hire Representation
Drunk drivers face criminal consequences, making these cases more complicated than other accidents. Our team can pursue a personal injury claim alongside ongoing criminal charges, even if the driver is incarcerated. Navigating the legal system after a car accident can be a burden in itself – let us carry that load by representing you in your claim.
Collier County DUI Laws
In Collier County, DUI convictions come with hefty legal consequences. Offenders may be fined, imprisoned, and have their license revoked at the discretion of the court. The court will consider the severity of the crash and the driver’s driving history in making this determination. First time offenders can face probation, up to six months of jail time, and a 1,000 fine.
In cases where a drunk driver causes severe bodily harm or wrongful death, the offender can face felony charges. Drunk driving is a serious offense that shouldn’t be handled lightly, and our attorneys can help you hold drivers accountable for their negligent or reckless decisions on the road.
