Your Naples Food Delivery Accident Could Result in Recovering Damages
If you win your personal injury case, you might recover various financial compensation. These damages can vary, but they generally cover your physical, emotional, and financial losses from the crash. Some types of damages you might recover include:
Medical Expenses
Many people injured in collisions with food delivery drivers are primarily concerned with the cost of their medical care. These expenses can be high, especially if insurance will not cover them for you. If another driver is at fault for your accident, you could recover compensation for your past and future medical expenses.
Pain and Suffering
Physical pain is a common consequence of a food delivery accident. While this type of compensation often makes up a large portion of a personal injury claim, it is important to remember that your no-fault insurance policy doesn’t cover these damages.
Lost Income
If your injuries prevented you from returning to work immediately after your accident, your income could suffer. Missing weeks or months of paychecks could have dramatic long-term consequences for your finances. If your injury case is successful, you might be able to recoup those lost earnings and other work benefits.
Types Of Lawsuits Related To Food Delivery Accidents
When our Naples food delivery car accident lawyer takes on your case, they will help you pursue the appropriate type of legal action. The nature of the injuries that occur in these collisions will determine which type of case is appropriate.
Personal Injury
Many accidents with food delivery drivers result in personal injury cases. It is important to understand that Naples is in Florida, a “no-fault” insurance state. That means a lawsuit might always be an option. In some cases, you might be limited to filing an insurance claim on your own policy.
Thankfully, our firm could help you make the case that legal action is appropriate. This is important, as your compensation from a personal injury lawsuit is likely higher compared to an insurance claim. Our firm could help you pursue your case against all the parties responsible for your crash.
Wrongful Death
Some injuries resulting from these accidents are fatal. If your loved one was killed in an accident with a food delivery driver, you might be entitled to the proceeds of a wrongful death action. Unlike personal injury cases, you would not be limited to filing an insurance claim in these cases. Our Naples wrongful death lawyer can help your family pursue a wrongful death action.

Who Pays For My Naples Food Deliver Car Accident?
Most people assume the other driver in their accident will ultimately be responsible for paying for their damages. While this can be true, you might be surprised at the number of individuals and entities that could be liable for our losses. Some of the parties that might pay for your accident include:
Insurance Companies
Insurance companies are frequently on the hook for damages in food delivery car accident cases. In fact, multiple insurance policies might be in place. The other driver must carry liability coverage just like all motorists. If they are at fault for your accident, their carrier could be on the hook for your damages.
What is unique about food delivery accidents is that the delivery company might provide coverage for your crash. When these drivers deliver for companies like Uber Eats, they typically have supplemental coverage from the company. This is important, as your damages could exceed the coverage the driver carries on their own.
In a no-fault state, you could also recover accident damages from your insurance policy. Your carrier could cover some of your losses depending on the nature of the crash. However, damages are available through a personal injury case not covered by your insurance.
The Other Driver
When another driver causes your accident and lacks insurance coverage, they are liable for your damages on their own. Holding these drivers accountable might be possible, but the lack of insurance coverage could make it difficult to recover the full compensation you deserve. Our Naples injury lawyers could help you identify assets of the delivery driver that could be used to pay your damages.
The Driver’s Employer
In some cases, the other driver’s employer might also be liable for your damages. This might not be the case if the driver is delivering for companies like Uber Eats that treats them as independent contractors. However, employees of local restaurants that are driving could make their employer liable for the crash if they were on the clock. In these cases, the driver and their employer could cover your damages.
