Fort Lauderdale car accident lawyers familiar with evidence collection may recover traffic cam footage to include in your case file. It could capture crucial details before, during, and after the accident. This footage can support your version of events and refute false allegations that might weaken your claim. It can also establish the validity of your injuries, objectively identify the at-fault vehicle and driver, and prove negligence.
You do not have to obtain camera footage or handle all the other moving parts of your case without assistance. An attorney in your area will clarify the role traffic cameras play in Fort Lauderdale car accident cases. They will also define the additional evidence necessary to prove the at-fault driver’s negligence and financial liability. Most local law firms will review your claim for free and describe their strategy for obtaining a financial recovery.
Traffic Camera Footage Can Play A Critical Role In Your Fort Lauderdale Car Accident Claim
After a car accident in Fort Lauderdale, the at-fault party’s insurance company will demand proof of its policyholder’s negligence. Moreover, they could want objective evidence and data to establish financial liability.
Video footage can be an invaluable tool in your evidence collection. However, it can be hard to obtain alone. If a Fort Lauderdale car accident attorney represents you, they may be able to access this data more easily
Traffic Cams Can Provide An Objective Overview Of A Fort Lauderdale Auto Accident
Traffic camera footage can give your legal team and the at-fault driver’s legal and insurance representatives a clear view of the accident scene. It can provide critical information, including all of the following:
- Direction of travel: Where each vehicle was positioned and in which direction it was headed can clarify who had the right of way and identify failure to yield or wrong-way driving, which could cause or contribute to a collision.
- Traffic violations: Traffic camera footage can prove the presence and position of traffic signs and signals, indicating which vehicle violated Fort Lauderdale’s rules traffic laws.
- Severity of injuries: Traffic cams could capture the extent of your injuries and how and when they occurred, aiding in proving their severity and subsequent physical and financial impacts.
- Date and time: Geographical, date, and time stamps can support your interpretation of the statute of limitations, a mandatory part of all car accident lawsuits in Florida.
A traffic camera can also capture the sequence of events leading up to the accident and aid in identifying a fleeing car or driver in a hit-and-run accident.
Images And Data From Other Cameras Can Support Your Car Accident Claim
A motor vehicle accident can seemingly come out of nowhere. Video evidence that supports your version of events can capture many of the moments leading up to the accident that you may not have noticed. Additional camera footage that can support your injury claim may come from:
- Parking lot cameras
- Smartphones
- Surveillance cameras
- Speed camera radars
- Truck driver dash cams
- Police body and dash cams
- Residential security cameras
- CCTV cameras from nearby businesses
Again, this evidence could be challenging to obtain without legal help. If a Fort Lauderdale car accident injury lawyer represents you, they and their investigative team could access these cameras and obtain their data for you.
How Traffic Camera Footage And Other Critical Evidence Prove The Key Elements Of Negligence
Recovering damages from the negligent driver means proving the elements of negligence—duty of care, breach of duty, causation, and damages. Additional evidence that may bolster your claim includes:
- Medical records and bills
- Written prognosis
- Salary history records
- Police reports
- Medical referrals
Your evidence collection may also include eyewitness statements and testimonials from relevant experts—medical, financial, accident reconstruction, and more.
The Importance Of Collecting Car Accident Evidence Immediately
Obtaining and preserving evidence is important. Traffic, dash, and smartphone camera footage can be lost, eroded, erased, or taped over without prompt collection. An experienced car accident lawyer can contact the appropriate agencies and owners to obtain camera footage as soon as possible.
Fort Lauderdale car accidents also have a filing deadline that you must meet. In general, you have two years to file your personal injury or wrongful death lawsuit, according to Florida Statutes § 95.11.
With limited exceptions found in Florida Statutes § 95.051, compliance is mandatory. Failure to file your lawsuit on time could mean you cannot file. A Fort Lauderdale personal injury lawyer can help you avoid this costly outcome.
Types Of Compensation Available For Fort Lauderdale Car Accident Victims
Economic damages are tangible and readily documented. They include all the costs of your treatment protocol—medical, rehab, and therapy bills. Economic damages also include assistive medical devices and prescribed medications. Additional economic damages you may be able to recover include:
- Past and future loss of income
- Loss of future ability to earn
- Treatment-related travel costs
- Property damage or total loss
- Diminished property value
The non-economic damages you may recover include disability, disfigurement, pain and suffering, mental and emotional anguish, and loss of enjoyment of life.
Wrongful Death Damages For Fatal Fort Lauderdale Car Accident Cases
While nothing can atone for your family’s loss, a Fort Lauderdale fatal car accident lawyer can fight to compel the at-fault party to compensate you for the financial consequences of a sudden loss. Wrongful death damages generally include:
- Funeral and burial costs
- Loss of financial support
- Loss of domestic services
- Loss of consortium
- Loss of companionship
- Loss of guidance and care
In general, the decedent’s parents, spouse, and children can recover damages from a wrongful death claim, per Florida Statutes § 768.21. You could also qualify for compensation if you were financially dependent on the decedent.
