Collecting Evidence for Your Drunk Driving Accident Case
When we investigate your drunk driving injury accident, we can secure a car accident report or police report to help us prove that the drunk driver’s negligence caused the crash. Additionally, the report might indicate how the crash occurred and whether the police cited the driver for a traffic violation.
But we do not rely solely on a police report. We conduct a thorough investigation of your accident and collect other evidence, such as:
- Photographs of the accident scene
- Photographs of your injuries
- Your medical records
- Statements from eyewitnesses
- Traffic camera or surveillance video
We may work with an accident reconstruction specialist to establish fault and determine how the accident occurred.
Additionally, if the impaired driver was convicted of a criminal drunk driving charge associated with your accident, we can use this as evidence that the driver’s negligence caused your personal injury.
We Fight Back If the Insurance Company Blames You for the Wreck
An insurance company will have an adjuster investigate your claim to determine whether you contributed to your injury. If the insurance company says you were partially at fault, the adjuster may try to reduce your recoverable damages in proportion to the percentage of fault they assign you.
A drunk driving accident lawyer in Miami Gardens from our firm will help you fight such allegations by building a solid, well-supported case.

You May Qualify for More Than Your PIP Benefits
Florida requires motorists to first turn to their Personal Injury Protection (PIP) insurance to cover their accident-related damages. PIP insurance covers:
- 80 percent of medical bills
- 60 percent of lost wages
- Death benefits of $5,000 per individual
But you may qualify for more compensation than that provided by your PIP coverage.
If another party caused your wreck – such as a drunk driver – you may qualify to file a lawsuit against the at-fault driver. A liability claim or lawsuit against the other driver may recover compensation beyond that provided by your PIP coverage.
Recoverable damage in a claim or lawsuit against the drunk driver include:
- Medical bills
- Rehabilitation costs
- Assistive mobility devices
- Future lost income
- Vehicle repair or replacement costs
You may also recover non-economic damages, which include:
- Pain and suffering
- Mental anguish
- Emotional distress
Your lawyer can help you better understand the recoverable damages in your case. We will fight for the full compensation you deserve for your physical, emotional, and financial losses.
We Can Negotiate for Compensation on Your Behalf
Depending on the circumstances of the accident, the impaired driver’s insurance company may offer a quick settlement for a personal injury claim.
We caution against accepting an initial settlement offer because the compensation amount may not cover all of your financial and emotional losses from the car accident. Your lawyer will fight for a settlement that takes into account the current and future finances you may need to pay your bills, get medical treatment, and take care of your family.
Our intention is to help you recover as much compensation as possible for your damages.
