Common Injuries of Ladder Fall Accidents Victims
According to the American Ladder Institute, each year thousands of people suffer disabling injuries from ladder-related accidents.
Some possible injuries related to ladder fall accidents include:
- Fractures of the lower extremities
- Knee and ankle joint sprains and strains
- Hip joint fractures
- Crushed or fractured bones
- Arm or hand fracture
- Internal injuries
- Back and neck damage
- Paralysis
- Brain damage
Are you experiencing any of these injuries due to a ladder accident? If so. contact us today.
Ladder fall accidents occur in and around the home but can also happen on the job. And, in many of these incidents, the cause may be a defective ladder, inadequate safety standards, or insufficient training.
Ladder Fall Injuries Sustained on the Job
If your injuries occurred while working, you have the right to medical treatment and other benefits through your employer’s worker’s compensation insurance.
Unfortunately, workers’ compensation might limit your ability to get comprehensive medical care for your injuries. And, no matter how much work you miss before the doctor clears you to return, workers’ compensation only covers a portion of your salary or hourly wage.
If you believe negligence by a third party (not your employer or a co-worker) contributed to your accident, you may also have the right to pursue legal action against that third party. A ladder accident and injury lawyer can advise you on the best course of action.
Talk to a construction site accident attorney in Fort Lauderdale about your case, as it may become more complicated than it appears to be. As we said, workers’ comp may cover a good portion of your damages and losses, but it may not be enough and other parties might be liable for your current predicament (for instance, the ladder manufacturer). Once you offer all the details about your situation, your lawyer will advise you on your rights and the best legal paths to explore for recovery.
Ladder Accident Injuries Sustained at Home
Handy homeowners may climb a ladder to get to the roof, wash a window, or change an overhead lightbulb. Unfortunately, when you buy a ladder, no one gives you a class in safety.
Before you blame user error for your injuries, however, consider the possibility that your ladder has a design flaw or manufacturing defect that caused you to fall and sustain an injury.
If your ladder did indeed have a defect that caused your accident, we could pursue a claim with the manufacturer or, in some cases, with the retail merchant.
Compensation & Liability for a Ladder Accident
The Centers for Disease Control and Prevention estimate that the annual cost of ladder injuries in the US is $24 billion, including work loss, medical, legal, liability, and pain and suffering expense.
When our legal team prepares your settlement claim to submit to the insurance company, we may pursue compensation for the following damages, depending on the details of your case:
- Lost wages to date
- Medical bills to date
- Future medical care costs
- Future loss of income and benefits
- Pain and suffering
- Lost life enjoyment
Your ability to pursue a settlement for negligence depends on the situation under which your ladder fall accident and injury occurred – whether at home or in the workplace. Your settlement also depends on whether you are comparatively negligent per Florida Statute 768.81 to determine if negligence was involved.
Whatever the facts of your case may be, we will call on our network of resources to substantiate your claim. Collected evidence may include:
- Testimony from medical experts and safety specialists
- Photos of the scene and equipment
- Any other information that will help us prove who or what is liable for your damages
