Recovering Compensation for Your Ladder Fall Accident Injuries
After a ladder fall injury, you will first turn to your employer’s workers’ compensation policy to cover your accident-related losses. Workers’ compensation covers:
- Necessary medical care
- The cost of gas to travel to and from doctor’s appointments
- A portion of your lost wages
- Death benefits
Recovering these benefits should be straightforward, but it rarely is. Insurers are businesses and as such, will do what they can to avoid paying you benefits. This might include wrongfully denying your workers’ compensation claim. Our team will fight to prove your injury stemmed from a work-related ladder fall and was not a result of any of the following exclusions to coverage:
- An intentional act (e.g., you jumped off the ladder in an attempt to injure yourself)
- You fell off the ladder because you were intoxicated or under the influence of drugs
You May Be Eligible for Additional Compensation
Workers’ compensation can be a lifesaver, helping you make ends meet after a ladder fall. However, it does not cover everything. If another party (aside from your employer) caused or contributed to your injuries, you may be able to hold it liable. Examples of work-related liability for a ladder injury include if someone:
- Failed to establish or enforce job site safety policies
- Failed to replace a worn or broken ladder
- Knew (or should have known) of a potentially hazardous situation but failed to act on that information
Liable parties may include a general contractor, another subcontractor, or a property owner. A ladder accident and injury lawyer can help you determine who is at fault so that you can pursue legal action to recover your damages.
