Our Coconut Creek Rideshare Accident Lawyers Will Pursue Full and Fair Compensation for You
Florida is a no-fault insurance state. Per Florida Statutes § 627.736, drivers must carry personal injury protection (PIP) and property damage liability (PDL) insurance. You generally must first file a compensation claim with your own insurance company, no matter who was at fault for the accident. If your damages exceed the limits of your PIP or PDL, you may be able to pursue compensation for your losses from another driver’s insurance company.
At the Law Offices of Anidjar & Levine, our Coconut Creek car accident lawyers can help you prepare and file your compensation claim with one or more insurance companies, including the rideshare driver’s insurance or the insurance carried by Uber, Lyft, or another rideshare company. Your compensatory damages in a rideshare accident claim may include:
- Current and future medical bills
- Property loss
- Current and future income loss
- Pain and suffering

What Insurance Covers Accident Victims in a Rideshare Crash?
If your injuries are severe, your costs may surpass your PIP limit. This is when the at-fault driver’s personal and/or rideshare insurance may be liable for your losses. The rideshare company’s insurance may also be liable, depending on the circumstances. Following is the basic structure for liability for damages related to an accident:
- If a rideshare driver is not working and their app is off, their personal insurance should cover damages.
- If a driver has the rideshare app on and is waiting for a ride request, their personal insurance, their rideshare insurance, or the rideshare company’s insurance may be liable.
- If the rideshare driver accepts a request and is in transit to pick up the passenger or has picked up the passenger(s), the rideshare company’s insurance is generally liable for damages.
- Once a passenger exits the rideshare driver’s car, liability for damages depends on whether the driver’s app is on and they are waiting for a new ride request or the app is off and they’re no longer working.

The Deadline to File a Personal Injury Lawsuit After a Rideshare Crash in Coconut Creek
Most compensation claims for traffic accidents are resolved through negotiations between the victim or the victim’s attorney and the liable party’s insurance provider. If those negotiations fail to reach an agreement, taking a compensation case to trial may be the only other option to recover fair compensation.
Florida’s statute of limitations (Florida Statutes § 95.11) generally gives you two years to file a personal injury lawsuit against the responsible party after a rideshare accident. Our legal team will handle the administrative tasks of your case, including tracking and meeting all deadlines.
