Using Your Personal Injury Protection Insurance
Florida drivers who suffer physical injuries and other losses in a vehicle accident can use their Personal Injury Protection (PIP) insurance. The state’s no-fault insurance covers damages regardless of who is at fault for the crash.
PIP covers 80 percent of your medical bills that include hospital stays, surgeries, rehabilitation, and diagnostic tests. You can receive:
- Up to the PIP limit of $10,000 if you were injured and suffered an emergency medical condition.
- $2,500 if you did not suffer an emergency medical condition.
To access these benefits, Florida requires you to get medical care no more than 14 days after the crash. You risk losing your PIP medical benefits if you do not meet the state-imposed deadline.
PIP also covers 60 percent of your lost wages and provides up to $5,000 for funeral and burial costs if a loved one passed away in a vehicle accident.
The Law Offices of Anidjar & Levine can help you access the PIP benefits you are entitled to after an uninsured motorist accident. Call us at 1-800-747-3733 to schedule a free consultation.
Using Your Uninsured/Underinsured Motorist Insurance
You can pursue compensation for accident-related losses that go beyond your PIP limits by using your Uninsured Motorist (UM) or Underinsured Motorist (UIM) insurance policy.
UM provides coverage when a driver who does not carry auto insurance causes an accident. This insurance also covers losses from a hit-and-run accident. UIM provides coverage when a driver has auto insurance but not enough to cover damages from an accident.
UM/UIM insurance pays for such damages as your:
- Medical expenses
- Lost wages
- Pain and suffering
Since UM/UIM is optional insurance coverage, you may not have this policy. Florida does not require drivers to carry UM/UIM insurance, but auto insurance companies must offer this coverage. Policyholders who do not want UM/UIM insurance are required to reject this coverage in writing.
If you do not have UM/UIM coverage, we can speak with you about other options you may have to recover compensation from an uninsured motorist accident.

Filing a Personal Injury Lawsuit
If losses from the accident go beyond your PIP limits, you may be able to file a personal injury lawsuit against the uninsured motorist. This is most likely the case if you suffered:
- Significant and permanent loss of an important bodily function
- Permanent injury with a reasonable degree of medical probability
- Significant and permanent scarring or disfigurement
- Wrongful death
Keep in mind that even if you win the lawsuit, the driver may not be able to fully pay you for your damages. A driver who does not pay for car insurance may not be able to afford the amount awarded in a lawsuit.
