Causes of Teen Driver Accidents
According to the Centers for Disease Control and Prevention (CDC), teens between the ages of 16 and 19 are at greater risk of crashing a vehicle than any other age group. Teens in this age range are also much more likely to die in a crash when compared to older drivers. Risk factors and causes for teen driver accidents and injuries can include:
- Inexperience
- Frequent weekend and nighttime driving
- Distracted driving
- Intoxicated driving
- Driving too fast
- Not using seat belts
However, in some cases, another driver can be responsible for a teen’s accident. According to the National Highway Traffic Safety Administration (NHTSA), most accidents happen due to driver error and for driver-related reasons, such as inattention and speeding. Other responsible parties in your teen’s accident could potentially include:
The Local Government Could Be Liable
If your teen lost control over their car due to a crack or another defect in the road, a local government entity could be responsible for the crash. This could also be the case when a road’s bad design contributed to causing an accident. Your lawyer can hire experts who will be able to determine whether a road defect played a role in your teen driver’s accident in Brandon.
A Carmaker Could Be Responsible
Cars are not always as safe as they should be. If a car part malfunctioned in your teen’s accident, such as a seat belt or airbag, you could have legal recourse against a car maker or car part manufacturer. These claims can get complicated and technical and will most likely require the help of expert witnesses and car accident reconstruction professionals.
Car accidents are not always as straightforward as they might seem to observers. In fact, you could have a case against several at-fault parties in your teen driver accident. A Brandon teen driver accident lawyer can help determine all at-fault parties and pursue damages from all potential avenues.
Take These Steps After a Teen Driver Accident
Teen drivers typically lack the driving and life-experience to know what to do after an accident. They may refuse important medical care or even apologize to another driver despite the accident not being their fault. Parents will have to make sure to protect their child’s legal rights as soon as possible. In the days after the accident, you should:
Make Sure Your Teen Sees a Doctor Promptly
Your teen should get a thorough medical checkup, even if they do not feel any pain or tell you that they only have minor symptoms.
According to the Mayo Clinic, some injuries, such as a traumatic brain injury (TBI) and whiplash, may not develop any symptoms for days or even weeks.
This potentially leaves you open to the at-fault driver’s insurance company arguing that the injuries have nothing to do with the car accident. Make sure your teen receives a medical report detailing all injuries from the accident.
Collect Evidence for Your Teen’s Damages
In order to be able to recover an adequate settlement, you will have to prove your teen’s damages with the appropriate documents, for example, copies of medical bills, receipts for out-of-pocket expenses, and bills for car repair costs. If your teenager is employed, you will also need evidence of loss of earnings, such as pay stubs and bank statements.
If you had to attend medical appointments with your teen or care for them as they recovered, you may have lost income as a result. Make sure to collect evidence for your loss of income and proof for any other expenses you incurred due to your teen’s accident.
