Filing A Wrongful Death Action Against The Responsible Party
According to Florida Statutes § 768.19, you can bring legal action against the responsible party or parties based on the following circumstances:
- Your loved one’s death was caused by the “wrongful act, negligence, default, or breach of contract or warranty” of another.
- Had your loved one been injured but not died, such actions on the part of another would have allowed them to take legal action to pursue compensation against the liable party.
The personal representative named in the will files the wrongful death claim for the survivors and the estate. If there is no will, the court will assign a personal representative—usually the spouse or other family member.
