Understanding Premises Liability In Slip And Fall Accidents
At the Law Offices of Anidjar & Levine, we draw on the two decades of experience our law firm has in protecting injured Floridians under the premises liability laws of our state.
In Florida, property owners and managers have a duty of care to keep their property safe for visitors. If there is a condition, like a wet floor or broken stair railing, that the owner or manager knew about or should have known about but did not fix or post warnings around, someone injured due to the dangerous condition can hold the owner/manager liable.
The level of liability held by the owner/manager depends on your status while on their property.
- Invitee: This is someone welcome and expected to be on the premises, such as shoppers in a store or those using a public park during open hours.
- Licensee: An invited licensee may be a social guest. An uninvited licensee may be someone coming onto the premises to ask for a signature on a petition or someone entering a shop to use the restroom and then leave.
- Trespasser: A trespasser has not been invited to be on the property and has no right to be there.
The level of duty of care changes depending on your status when you are on another’s property. It can also change if the injured person is a child, rather than an adult. Our Beverly Beach slip and fall accident lawyers will explain what you should know about slip and fall accidents, how the premises liability laws apply to your case and what your legal options are when pursuing compensation.
Legal Deadlines For Filing A Slip And Fall Lawsuit In Florida
You and your attorney can seek a compensation settlement for your injuries from the insurance company. If there is no negotiated agreement, you can file a personal injury lawsuit for compensation.
According to Florida Statutes § 95.11, you generally have two years from the date of the accident to file a lawsuit. After that, you may be barred from doing so. You will learn more about this from our attorneys as plans for your case are made.
