Only A Qualifying Representative Can File A Wrongful Death Action
In Florida, only qualifying representatives are able to file a wrongful death claim with the insurance companies on behalf of a decedent.
Under Florida Statute § 768.21, the following people are beneficiaries of this type of legal action:
- The decedent’s surviving spouse
- The children of the decedent
- The decedent’s parents
- A personal representative of the decedent’s estate

Your Time To Act On Your Melbourne Case Is Limited To Two Years
You are not given unlimited time to file a wrongful death lawsuit. Under Florida Statute § 95.11, you have two years from the date of your loved one’s passing to pursue a civil action.
For this reason, we encourage you to reach out to a Melbourne wrongful death lawyer as soon as you can. If you do not act within the state’s statute of limitations, you will be barred from filing a lawsuit against the negligent party in the Brevard County courthouse.

Situations That Could Result In A Wrongful Death Action In Melbourne
Since 2005, our goal has always been to help our clients receive compensation that accurately reflects their economic and noneconomic damages. In that time, we have seen various situations that could serve as the basis of a wrongful death claim, including:
- Auto Accidents: Motor vehicle accidents can have multiple liable parties and require an in-depth investigation to prove fault. Our Melbourne car accident lawyers will interview witnesses, secure any available footage from the accident scene, and prove negligence.
- Truck Accidents: When a commercial vehicle is involved, liability can be complicated as it may be shared between the truck driver, their trucking company, and third parties. Our Melbourne truck accident attorneys will determine all responsible parties to hold them accountable.
- Motorcycle Accidents: In motorcycle crashes, blame can be unfairly shifted onto cyclists. Our Melbourne motorcycle accident lawyers will gather evidence to prove who was at fault.
- Slip and Fall Accidents: Property owners owe a duty to the public to keep their properties safe. Our Melbourne slip and fall lawyers will hold them accountable when they fail to do so.
- Medical Malpractice: Whether a surgical error, misdiagnosis, anesthesia error, or hospital negligence, our Melbourne medical malpractice lawyers will fight for the fair compensation you deserve after the loss of a loved one.
Regardless of the circumstances that led to your loved one’s passing, our legal team can help.
How We Help Families Establish Negligence In Wrongful Death Cases
A Melbourne wrongful death lawyer can provide you with a range of services to build your wrongful death case. We will need to show that the four elements of negligence have occurred. These are:
- Duty of Care: The liable party owed your loved one a duty of care to keep them safe. For example, a surgeon must follow reasonable medical guidelines to avoid surgical errors.
- Breach of Their Duty: Failure to act with care and caution. For example, a lab technician whose preventable lab error leads to a misdiagnosis.
- Causation: The breach led directly to your loved one’s passing. For example, a doctor delayed performing a necessary C-section, and it led to the loss of a baby.
- Damages: Your family suffered losses, such as medical bills, pain and suffering, and disability.
To prove these elements have been met, we will do a thorough investigation. This may include gathering evidence like witness statements, medical records, incident and police reports, and expert testimony. When handling your case, we will also:
- File your wrongful death claim
- Pursue the cost of your incurred expenses
- Negotiate a fair settlement or follow through on a wrongful death lawsuit
While you are mourning your loved one’s passing, Anidjar & Levine will undertake your legal burdens.
