Applications for Social Security disability are on the rise, but Social Security Administration (SSA) denies many of the applicants. That means that many disabled individuals do not receive the benefits they truly deserve.

Social Security Disability
If a physical or mental condition keeps you from working and earning a gainful income, you may be eligible for Social Security disability benefits. Over your years of work, you may have noticed that you paid Social Security taxes on a regular basis. If a disabling condition causes you to stop working before reaching retirement, this government program provides monthly benefits to you and your children if you qualify.
Qualifying for Social Security disability benefits can be tricky, and the process can be long and challenging.
Two Different Programs
There are two different types of Social Security programs. One is Social Security Disability Insurance (SSDI); the other is Supplemental Security Income (SSI).
SSDI is primarily for people who are fully disabled and unable to work. SSI, on the other hand, is for people in need with limited income.
Administrative Law Judge Hearing
Even if SSA denies your claim, there is hope. The next step is to request a hearing before an Administrative Law Judge (ALJ), and the approval rate is higher at this stage of the process. Even if an ALJ denies your claim, you can request reconsideration from the federal district court. At any stage of the process, your chances for approval are greater with a Social Security disability lawyer by your side.
The attorneys of The Law Offices of Anidjar & Levine have helped many people in Florida get the disability benefits they deserve. Whether you are applying for Social Security disability for the first time, or SSA has already denied your claim, we want to help you receive the disability benefits you deserve. Qualifying for Social Security Disability Insurance (SSDI)
Disability benefits are typically for individuals whose impairment prevents them from working for a year or longer. To qualify for Social Security disability, you must have worked and paid into Social Security for a period of time. The time requirement varies depending on your age. You must show your disability prevents you from gainful employment.
You must also prove your disability according to SSA standards. SSA will consider your medical history, medical records, and other evidence that demonstrates disability.
Disability Eligibility Factors
Some disability eligibility factors may include:
- Current employment status
- Disabling condition
- Ability to do the work you did before
- Ability to do other types of work
- How your condition interferes with work-related activities
- Your age
- Work experience
- Education level
- Transferable skills
- If your impairment is on the SSA impairment list
If SSA approves your claim for SSDI, you will receive monthly payments while you are unable to work. SSA also has programs to help you transition back into working when and if you are able.

Supplemental Security Income (SSI)
SSI is a needs-based program that provides income to those who are blind, disabled, or 65 or older with limited income. Just like SSD, the same standards for disability apply.
The work requirements of SSDI do not apply to SSI. Even if you have never paid taxes, you may be eligible for SSI benefits. To qualify for SSI, you must show you have limited income and assets. SSI recipients are also eligible for Medicaid and food stamps.
If you are unable to work due to your condition and your earnings are lower than the allowable income limit, you may be eligible for SSI. To make sure you have the best chance of receiving all the disability benefits you deserve, speak to one of our Social Security disability lawyers in Florida as soon as possible.

A Florida Social Security Disability Lawyer Can Help You with Your Claim
Thousands of people apply for Social Security disability benefits each year. Unfortunately, Social Security Administration denies many of those claims. Some applicants must go before an administrative law judge for a disability ruling. While you can represent yourself, it may be in your best interest to have a disability lawyer to represent you.
Getting Social Security disability can be very challenging. The approval rate in Florida is low, so you want to do everything possible to obtain the benefits you need for you and your family. Hiring a Florida Social Security disability lawyer is a good first step. There is no fee unless you win, and fees will not exceed 25 percent of your past benefits.
Finally, yet importantly, if you have a disability but an entity (such as an employer) discriminates you based on your disability, medical record, health status, etc., you can consult with our Fort Lauderdale ADA lawyer to understand your rights and your legal options. Our ADA claims and violations attorney will review your situation and advise you regarding the necessary steps to take to fight against discrimination.
