You could recover compensation for your whiplash injury
Those suffering from a mild whiplash injury may not have large medical bills and income losses. For such individuals, the recovery time can be as short as a few days or weeks. However, severe or chronic whiplash could cause pain and debilitating headaches for years after an accident due to damage to the ligaments and discs.
Trying to treat and eliminate severe or chronic whiplash can cause high medical bills and lost wages. If your whiplash occurred due to a driver’s (or another party’s) negligence, you can seek damages such as:
- Medical expenses
- Expenses for medical accessories, such as a neck brace
- Lost income
- Future medical costs and future lost income
- Physical pain and suffering
- Mental distress
This list is not exhaustive. You could recover additional damages, as every accident case is unique. There is no average settlement in whiplash injury claims. In general, the more serious a victim’s injuries, the higher the damages and a settlement could be.

Our legal team can gather evidence to prove negligence
One of the services we offer to help you prove another party’s negligence involves gathering various forms of evidence. This can include:
- Photographs of the accident
- Police reports
- Medical records
- Statements from witnesses
- Black boxes from any involved vehicles
This process may also require extensive research and the opinion of accident reconstruction professionals and other expert witnesses. We can provide the relevant testimony and help you navigate all aspects of a personal injury claim or lawsuit.
Visit a doctor if you suspect that you have whiplash
If you were involved in a rear-end collision or another incident in which your head moved forcefully back and forth during impact, you might have suffered a whiplash injury.
Sometimes, accident victims don’t know that they have experienced a whiplash injury right away, which is why it’s beneficial to see a doctor as soon as possible after an accident. According to Mayo Clinic, individuals may not necessarily experience any symptoms—or may only have minor signs at first. Whiplash can cause:
- Pain in the neck area
- Neck stiffness
- Pain with neck movement
- Loss of range of motion of the neck and upper back area
- Headaches
- Tingling or numbness
- Dizziness
It may be worth visiting a doctor for a check-up to rule out any serious injuries. Consider that a doctor’s visit will also provide you with a medical report. You will require this as proof of your injuries, particularly if you hope to recover damages from the insurance companies or in a lawsuit.
Does whiplash count as a severe injury?
In many cases, a whiplash injury is not particularly severe and can heal on its own. However, individuals who experienced a serious car accident or have a repeat whiplash injury can potentially suffer an extreme case. Unlike mild whiplash, severe whiplash can cause chronic pain and may have long-term consequences that prevent an individual from working.
Those who suffered from severe whiplash may face steep medical bills and income losses. If this has happened to you, a St. Petersburg whiplash injury lawyer from our office can offer advice regarding the possibility of recovering damages from the negligent party.
We can file your case in accordance with the statute of limitations
Under Florida Statute § 95.11(3)(a), victims of accidents generally have four years from the date of their injuries to file a lawsuit. However, you should consider seeking legal advice sooner.
Gathering the essential pieces of evidence after four years have passed can be tricky, and any eyewitnesses may not recall all the details of your accident. The sooner you get started with the process, the sooner we could help you recover your due.
