Being involved in a car accident can leave you with life-changing injuries or post-traumatic stress disorder. Your physical and emotional suffering change how you handle different aspects of life, including your finances. The medical bills, insurance claims, and legal paperwork can be overwhelming when you are still trying to recover from your accident-related injuries. If all of this was caused by the negligence of a drunk driver, it may be even more difficult to find and take your next steps.
At the Law Offices of Anidjar & Levine, our Pembroke Pines drunk driving car accident lawyer can stand by your side to alleviate some of your stress. We aim to provide responsive legal care by making ourselves available to answer your questions and concerns. Our Pembroke Pines Drunk Driving Accident Lawyer Can Help You
After you are involved in a car accident, you may be unsure of what to do or how quickly you need to file. This process can take a lot of time and energy, hindering the recovery process. Our car accident lawyer wants you to focus on getting better, while we take care of everything else.
When you hire a member of our team, we will provide support and guidance during your case. Some of the ways we will help include, but are not limited to:
- Investigating your accident. Once we take on your case, we will look into what led to your injuries. We will use our resources, working with other professionals and any witnesses to uncover evidence that supports your claims.
- Negotiation with insurance. You may think your insurance company has your best interests in mind, but negotiating a settlement can be more complex than you might anticipate. Having a lawyer by your side with knowledge of the law, your accident details, and what you need for compensation can give you the upper hand in negotiations.
- Determining recoverable compensation. After an accident, you may be unable to see the extent of your losses while you’re in the middle of recovering. Our lawyer can assess your damages to create an estimate of what you need. We will help you gather all the information needed to calculate an appropriate amount.
- Fill out paperwork and consider deadlines. Paperwork that needs to be filed following an accident can be time-consuming and overwhelming, especially when you have a timeline to follow. It’s important you contact us as quickly after the accident in order to give us ample time to prepare and file your case. According to Florida Statutes § 95.11(3)(a), you have four years from the date of the accident. Although four years may seem like a long time, it can go quickly and negotiation with insurance can sometimes take longer than expected.
You Matter To Us
When you hire an attorney from the Law Offices of Anidjar & Levine you no longer have to deal with this alone. We will provide legal guidance while answering all your questions, responding to your calls and emails, and giving frequent case updates. We want to be accessible to you during this time, which is why you get your attorney’s phone number.
We understand how quickly bills can start piling after an accident, which is why we work on a contingency fee basis. This means we don’t require any money upfront to get started on your case and won’t get paid until you do. We also schedule your appointments and arrange for your car to be repaired.
You’ve got a lot on your plate, and we don’t want to add to those burdens. Allow us to take on these responsibilities while we fight for your financial recovery.
What Types Of Recoverable Damages Can I Receive From My Car Accident?
Accidents are unique from one another, which means the recoverable damages also differ based on the circumstances of your case. Generally, there are two types of recoverable damages: economic and non-economic.
Economic damages are easier to place a monetary value on. Examples of economic damages are:
- Medical expenses. This includes medical attention you have already received as well as any treatment you need in the future. It is important to know the full extent of your injuries as well as your treatment plan when determining this amount. This is why we consult your physician and other experts to create an appropriate estimate.
- Change of income. If your injuries have changed the way you are able to make an income, you could recover damages. Whether your income losses are short or long-term, we can demand compensation for these changes in your earning capacity.
- Property damage. Costs of vehicle repair or replacement can also qualify as economic damages. In some cases, we may be able to secure the diminished value of your vehicle.
Non-economic damages are harder to measure. Examples of non-economic damages are:
- Pain and Suffering. This can include physical pain from your injuries or treatment as well as the mental and emotional effects of the accident and your injuries.
- Physical disability or disfigurement. As a result of the accident, you may need to make accommodations to your home in order to make things more accessible. These expenses can be accounted for in your demands. If you suffer due to the inconvenience of your loss of mobility or independence, then you should be compensated for these, too.
- Loss of enjoyment of life. If you can no longer participate in the same activities you did prior to the accident, you may be able to receive damages for loss of enjoyment of life.
The Responsible Driver Must Be Held Liable
In order to build a case, there must be criteria present to demonstrate that the at-fault driver is financially responsible. In Florida, injured people can typically only recover compensation through the other driver’s insurance if their injuries are severe. If your case is able to be escalated through a lawsuit, your attorney will need to prove that the other driver was negligent.
Drunk driving is egregiously negligent behavior. The National Highway Traffic Safety Administration (NHTSA) states even a blood alcohol concentration level of .02 can affect driving, even though the legal limit is .08. Our investigation will lead us to the proper documentation to prove the driver had enough alcohol in their system to affect their driving ability and cause the accident.
