The U.S. Geological Survey defines a sinkhole “as a depression in the ground that has no natural external surface drainage.” Essentially what happens is that porous rock below the surface wears away over time and suddenly collapses in on itself. This can result in anywhere from minor cosmetic damage to one’s property to swallowing entire homes.

Florida Law Protects Homeowners
The Florida Office of Insurance Regulation reports that Florida is the sinkhole capital of the nation. In fact, sinkholes are so frequent that homeowners’ insurance must include sinkhole coverage, as detailed in Florida Statute 627.706. Keeping this in mind, if your home in Miami suffered full or partial damage from a sinkhole, your homeowners’ insurance company may cover repair costs or, in the case of a total loss, the value of your home that was destroyed. Yet, some insurance companies are notorious for not paying policyholders what they should, particularly in so-called “acts of God” situations.
At the Law Offices of Anidjar & Levine, we build cases on behalf of our clients, and we take on insurance companies. To learn more about what a Miami sinkhole property claim attorney can do for you, call us today.
How a Miami Sinkhole Property Claim Lawyer Can Be a Valuable Asset
Sinkholes happen without warning. You may have to relocate your family, and you could find yourself facing thousands of dollars in lost or damaged property. The last thing you want to do is deal with an insurance company that is not working in your best interests.
Some of the ways a property claim attorney can help include:
- Keeping your claim on schedule. Insurance companies may delay your payment, hoping you will get desperate enough to accept anything they offer (or much less than you deserve) just to get paid in a timely fashion. Floridians are protected under the Homeowner Claims Bill of Rights, which outlines an appropriate timeframe in which your insurer must resolve your case.
- Negotiating for a fair settlement. Your insurer may look for a loophole or clause that absolves them of responsibility for your sinkhole-related losses. Your lawyer can point out that all Florida homeowners’ insurance policies should cover sinkhole damage and can fight for your right to compensation.
- Estimating the value of your claim. When you give your lawyer documentation that points to the cost of your losses, they can provide an accurate estimate as to the value of your expenses. Your insurer may try to “lowball” you, offering much less than you deserve. Without a lawyer investigating your case, you may not understand the full value of your claim.
