How the Law May Be Able to Help
Courts have a responsibility of trying to make an injured party whole again. In other words, the judge should try to remedy the damage caused if you were hurt while traveling on a broken sidewalk by awarding your monetary compensation. This compensation typically accounts for things like:
- Hospital invoices
- Ambulance bills
- Therapy services
- Medical equipment
- Pain and suffering
While most of these are a straightforward matter of accounting, the final item is more subjective. Courts have a number of different avenues they may take in calculating pain and suffering damages, and your Jacksonville cracked or defective or broken sidewalks lawyer will be able to explain this in full detail.
One typically relevant law to these cases is the Florida premises liability law. As Florida Statute § 768.0755 shows, there are a number of conditions that may be met to prove liability. Overall, you have a better case if you can show that the owner of the sidewalk should have been aware of the damage and the danger it posed to the public.
Jacksonville personal injury lawyers owe their clients a duty of care in collecting all relevant evidence and bringing it before a jury if need be. The Law Offices of Anidjar & Levine will be able to provide a full discovery process for you to achieve this goal. This may be vital to building a solid legal case for personal injury, so call our office as soon as you can.
Why Many Floridians Act Quickly After An Injury
PerFlorida Statute § 95.11, people typically cannot sue for injuries that happened more than four years ago in Florida. However, there are many reasons why people choose to act sooner rather than later after an injury by hiring a Jacksonville cracked or defective or broken sidewalks lawyer. Primarily, evidence does not last long in the field. Sidewalks may be repaired, and obstacles may be removed from having blocked a line of sight. This is why it is important to collect evidence quickly and build a case as fast as possible in order to maximize the potential evidentiary weight of your case.
