Unfortunately, you cannot purchase rental car insurance coverage after a Miami car accident has already occurred. Rental car coverage must be in place before the accident happens to provide benefits. However, you may still have other options for getting a rental car covered through existing insurance policies or by pursuing compensation from the at-fault driver.
Our experienced Miami car accident lawyers at Anidjar & Levine help clients explore all available options for rental car reimbursement after accidents when they didn’t purchase rental car coverage up front. You may have coverage options that you’re unaware of, such as through your credit card or an auto club membership.
Why You Cannot Add Rental Car Coverage After an Accident
Insurance companies require all coverage to be purchased before a loss occurs. This fundamental principle prevents people from buying insurance only after they need it, which would make insurance financially unsustainable for companies.
Rental car coverage, also known as rental reimbursement coverage, is an optional add-on to your auto insurance policy. Like all insurance coverage, it must be selected and paid for during your policy term, not after an accident happens.
Understanding Insurance Contract Requirements
Insurance policies are contracts that specify coverage effective dates and terms. Adding coverage after an accident would constitute insurance fraud, as you’d be attempting to receive benefits for a loss that occurred before coverage began.
This is why insurance companies carefully document when coverage changes take effect. Any modifications to your policy, including adding rental car coverage, typically require advance notice and cannot be backdated to cover existing claims.
Existing Coverage Options That May Help
Even without specific rental car coverage, you may have other insurance options available to help with transportation costs. Review your current auto insurance policy carefully, as you might have coverage you weren’t aware of.
Some comprehensive insurance policies include limited rental car benefits as part of other coverage types. Collision coverage occasionally includes temporary transportation allowances while your vehicle undergoes repairs.
Credit Card and Other Benefits
Many credit cards offer rental car coverage when you use the card to rent a vehicle. While this doesn’t pay for the rental upfront, it may provide reimbursement if you need to rent a car while your vehicle is being repaired after an accident.
Some auto club memberships, like AAA, include limited rental car discounts or emergency transportation benefits. Employee benefits packages occasionally include transportation assistance programs that could help during vehicle repairs.
Homeowner’s or Renter’s Insurance Considerations
Some homeowner’s or renter’s insurance policies include limited coverage for temporary transportation expenses following covered losses. While this typically applies to situations where your home becomes uninhabitable, some policies have broader transportation coverage provisions.
Check with your insurance agent about any ancillary benefits that might apply to your situation. Even small amounts of coverage can help offset rental car expenses during vehicle repairs. To fully explore your options for rental car coverage after a Miami car accident, we encourage you to speak with a lawyer.
