Being hurt on the job is one of the biggest challenges any worker can face. One minute, you’re working, and the next minute, you’re in an ambulance. The Law Offices of Anidjar & Levine has been helping people all over Florida in your situation for years. Our Deltona personal injury lawyers believe that people who have been hurt on the job should be treated with the utmost respect. If your employer’s workers’ compensation carrier isn’t giving you that respect, consider contacting our office to see what we can do for you.
Why Are Workers’ Compensation Claims So Tough On Workers?
Workers’ compensation claims are some of the toughest cases we handle. They’re tough on workers because of how the workers’ compensation process is set up. If you’re hurt on the job, you won’t be negotiating your claim with your employer. In fact, after you’ve alerted your employer that you have a job-related injury and they send you to a designated healthcare provider, your employer likely won’t play any further role in the process.
That’s because your employer won’t be paying your salary or benefits while you’re out of work. The workers’ compensation insurance carrier that covers your company will handle the entire process. Having workers’ compensation insurance protects employers from going out of business if they can’t afford to pay your claim or multiple claims at once.
Unfortunately, it also puts injured workers like you into a situation where they have to seek compensation from a third party with a strong financial motivation to deny or undervalue claims. Workers’ compensation insurers enjoy collecting premiums way more than paying claims. Why? Because paying claims means smaller profits.
If you’re stuck between an insurance company and its profits, getting fair compensation may not be so easy. That’s where a Deltona workers’ compensation lawyer from our team can help.
What Can A Deltona Workers’ Compensation Attorney From The Law Offices Of Anidjar & Levine Do For You?
The most important thing a Deltona workers’ comp lawyer from our firm can do is fight for you! In workers’ compensation claims, the insurance company has the resources to wait you out. They know you’re hurt and that you have bills piling up. So, they may try to make the claims process as difficult as possible in hopes you’ll take what they give you and go away. But we’ll work hard to keep that from happening.
The workers’ compensation insurance carrier may act like their ruling on your claim is final, but it’s not! Examples of the assistance our workers’ compensation team can provide for you include:
- Filing an appeal contesting the denial of your claim
- Collecting evidence in support of your claim
- Negotiating your case with the insurance carrier
- Representing your case in court (if necessary)
Additionally, if there are any third-party actors whose negligence contributed to your injury, we may be able to pursue them for damages. For example, if the landlord of the building where you were working did not maintain the building in accordance with county code, and this failure caused your injury, we may be able to pursue them for damages. Those damages would be in addition to your workers’ compensation claim.

What Are The Most Common Reasons For A Workers’ Compensation Claim Denial?
Workers’ compensation insurance carriers can deny a claim for various reasons. Some of the reasons they may deny your claim include:
- They don’t believe your injuries are work-related.
- They believe you injured yourself on purpose to file a claim.
- They believe you were intoxicated at the time of your injury.
- They believe your injury resulted from your own negligence (e.g., goofing around with co-workers or failing to abide by workplace policy).
- They don’t believe your injuries are sufficient to merit workers’ compensation.
You have a legal right to appeal a claim denial, or cessation of benefits, by a workers’ compensation insurance carrier. You should also remember the insurance company has a strong financial incentive to deny your claim, even if it is legitimate.
So, the mere fact that your claim was denied does not mean you have no recourse. You wouldn’t be the first person to fight a claim denial, and you won’t be the last.
How Much Can A Deltona Workers’ Compensation Attorney Get For Your Case?
No two workers’ compensation claims are alike. That’s because there are so many unique variables that go into determining the value of each case. Examples of those variables include:
- The severity of your injuries
- How much work you miss
- How much you were earning at the time of your injury
- Whether you can return to work again
Our Deltona workers’ compensation attorneys will analyze your claim in detail and make it our mission to fight for every penny you deserve.
