Helping Personal Injury Clients Is Our Priority
Our team of personal injury lawyers in Fort Lauderdale knows how challenging it can be to concentrate on a civil case when you are still grappling with the aftermath of a shocking, painful accident. You may be wondering what to do next, asking yourself questions like, “How am I going to pay for my injuries and missed work? And whom can I hold responsible?” Rideshare accidents present more obstacles than other car accident cases for many reasons. Your lawyer will ask some questions and assess your situation by:
- Identifying the liable party: Is the rideshare driver alone responsible, or is the rideshare company itself to blame? Whose insurance company should offer compensation? What role does your own insurer play?
- Dealing with insurance companies: Will the driver’s personal car insurance pay for your damages?
- Collecting evidence: What forms of medical documentation would support your case? Do you have anything that could support your right to damages?
- Filing paperwork: What forms do you have to fill out to make your lawsuit official, and to whom must you send them?
- Going to court: If you cannot convince the insurance company to pay a fair settlement, could a lawsuit yield compensation? How does Uber or Lyft respond to civil lawsuits?
Our Fort Lauderdale rideshare attorneys can do all these tasks and more on your behalf.

A Fort Lauderdale rideshare accident lawyer knows how to navigate these complexities, gather the right evidence, and fight back against insurers who may try to undervalue or deny your claim.
Local experience also matters. Our attorneys are familiar with Broward County courts, judges, and insurance adjusters, as well as the unique driving conditions in Fort Lauderdale—from heavy tourism traffic near Port Everglades to busy commuter routes on I-95. This insight allows us to anticipate challenges and build stronger cases for our clients. Common Causes of Rideshare Accidents in Fort Lauderdale
Rideshare drivers in Fort Lauderdale often face unique challenges on the road. Heavy tourism traffic, cruise ship arrivals at Port Everglades, and crowded areas like Las Olas Boulevard or A1A can make driving especially stressful. When drivers are focused on their apps, finding passengers, or navigating unfamiliar neighborhoods, accidents can happen quickly.
Some of the most common causes of Uber and Lyft crashes in Fort Lauderdale include:
- Distracted driving: Using the rideshare app, answering texts, or talking with passengers takes a driver’s attention off the road.
- Fatigue: Many drivers work long hours or late nights after other jobs, making drowsiness a major risk, especially around nightlife areas like downtown Fort Lauderdale or Wilton Manors.
- Speeding: To fit in more rides during peak times, drivers may rush through busy intersections such as Sunrise Boulevard or Andrews Avenue.
- Inexperience: Some rideshare drivers have little professional driving experience and may struggle in high-traffic conditions or sudden Florida rainstorms.
- Traffic law violations: Improper lane changes, ignoring red lights, or failing to yield are frequent causes of accidents in urban areas and on highways like I-95 and I-595.
Understanding these risks is important not just for building a strong legal claim, but also for helping accident victims recognize the patterns that may have led to their crash.
Rideshare Accidents Can Cause Significant Injuries to Passengers and Other Drivers
The impact of a rideshare accident can leave victims with a wide range of injuries, some of which may take weeks or months to fully recover from. These injuries can disrupt not only your health but also your ability to work, care for your family, and enjoy daily life. Some of the most common rideshare accident injuries include:
- Whiplash and neck injuries: Sudden collisions can strain the muscles and ligaments in the neck, leaving victims with stiffness, headaches, and lasting pain.
- Traumatic brain injuries (TBI): Concussions and more severe brain injuries may occur if your head strikes a window, dashboard, or airbag. These can affect memory, concentration, and overall quality of life.
- Broken bones and fractures: Arms, legs, ribs, and hips are particularly vulnerable in car crashes and may require surgery or lengthy rehabilitation.
- Back and spinal cord injuries: Damage to the spine can cause chronic pain, herniated discs, or even paralysis in severe cases.
- Soft tissue injuries: Sprains, strains, and bruising may sound minor, but they often cause long-term discomfort that interferes with daily activities.
- Emotional trauma: Beyond physical injuries, many accident victims develop anxiety, depression, or post-traumatic stress disorder (PTSD) after a serious crash.
No matter how minor your injuries may seem at first, it is crucial to seek medical care quickly at facilities like Broward Health Medical Center or Holy Cross Health. Prompt treatment not only protects your health but also creates a medical record that supports your claim for compensation.
Determining Liability in Fort Lauderdale Rideshare Accidents
Figuring out who is legally responsible after a rideshare accident can be complicated. In Fort Lauderdale, liability may fall on several different parties depending on the circumstances of the crash. Your attorney’s job is to investigate every angle so you can pursue the maximum compensation available under Florida law.
The rideshare driver may be personally liable if their negligence caused the accident. In other cases, Uber or Lyft could share responsibility. These companies may be held accountable for negligent hiring, training, supervision, or retention if they knew—or should have known—about a driver’s unsafe behavior. Other motorists, vehicle manufacturers, or maintenance providers may also be at fault if their actions or defective products contributed to the crash.
Proving liability requires a thorough investigation. This can involve reviewing the police report from local law enforcement, analyzing rideshare app data, examining driver records and passenger complaints, interviewing witnesses, and even securing video from traffic or surveillance cameras near busy areas like Las Olas Boulevard. Your lawyer can request important documentation such as safety inspection reports, maintenance logs, and in-vehicle monitoring data. Preserving this evidence quickly is essential to building a strong case.
How the Rideshare Driver’s Status Affects Insurance Coverage
In addition to identifying who is at fault, it is important to understand how the driver’s status in the app affects insurance coverage. Uber and Lyft policies apply differently depending on whether the driver was available for rides, en route to a passenger, or actively transporting someone at the time of the crash.
- Waiting for a ride request: Limited liability coverage applies—$50,000 per person/$100,000 per accident for bodily injury, and $25,000 for property damage—if the driver’s personal insurance does not cover the loss.
- Heading to pick up a passenger or actively transporting one: The rideshare company’s $1 million liability policy is in effect, covering injuries to passengers, third parties, and the driver if struck by an uninsured motorist.
- Not logged into the app: The driver is considered off duty, and only their personal auto insurance policy applies.
Because these rules can be confusing, many accident victims are unsure of where to turn for compensation. A Fort Lauderdale rideshare accident lawyer can sort through these details, identify all available sources of recovery, and make sure the right parties are held accountable.
Florida’s No-Fault Insurance and Rideshare Accidents
Florida is a no–fault insurance state, which means that after most car accidents, you must first turn to your own insurance for coverage, regardless of who caused the crash. Every driver in Florida is required to carry at least $10,000 in Personal Injury Protection (PIP) coverage. This insurance can help pay for medical expenses and a portion of lost wages after a rideshare accident.
However, PIP has important limits. It only covers up to 80% of reasonable medical bills and 60% of lost wages, and once your benefits are used up, you may still face significant out-of-pocket costs. In addition, PIP does not cover pain and suffering.
If your injuries meet Florida’s serious injury threshold, you may step outside the no-fault system and pursue a claim against the at-fault party. In rideshare cases, this could mean filing against the Uber or Lyft driver, the rideshare company’s insurance, or another negligent motorist.
Because rideshare accidents often involve multiple layers of insurance—your PIP, the driver’s personal policy, and Uber or Lyft’s commercial coverage—it can be confusing to know where to start. A Fort Lauderdale rideshare accident lawyer can review your policy, explain your rights under Florida law, and identify the best way to seek full compensation.
Steps to Take After a Rideshare Accident in Fort Lauderdale
What you do immediately after a rideshare crash can have a major impact on both your health and your ability to recover compensation. If you are involved in an Uber or Lyft accident in Fort Lauderdale, here are some important steps to follow.
- First, make sure you and others are safe and call 911 right away. Emergency responders can provide medical help on the scene, and an official police report from the Fort Lauderdale Police Department, the Florida Highway Patrol, or the Broward Sheriff’s Office will be an essential piece of evidence for your claim.
- Next, seek medical care as soon as possible, even if you believe your injuries are minor. Local hospitals such as Broward Health Medical Center and Holy Cross Health can evaluate you for hidden injuries like concussions, whiplash, or internal trauma that may not show symptoms right away.
- Exchange information with everyone involved in the crash, including drivers, passengers, and witnesses. Be sure to get names, contact details, insurance information, and note whether the rideshare driver was logged into the app and carrying passengers at the time.
- Document the accident scene by taking clear photos of the vehicles, visible injuries, road conditions, and nearby traffic signals. In busy areas like Sunrise Boulevard or Las Olas, you may also want to check for traffic or surveillance cameras that could have captured the collision.
- Report the accident to Uber or Lyft through the app or by contacting customer support. This creates an official record of the crash and may become important during the insurance process.
Finally, avoid admitting fault or making detailed statements to other drivers or insurance adjusters before speaking with an attorney. Consulting a Fort Lauderdale rideshare accident lawyer as soon as possible can help protect your rights, preserve valuable evidence, and relieve you of the stress of handling complex insurance claims on your own.
Evidence in Your Uber or Lyft Rideshare Case Must Prove Your Claims
We also advise Uber or Lyft accident victims to act quickly to preserve evidence. As part of our investigation, we often request:
- Medical records
- The official police report
- Interviews and other materials from witnesses
- Statements from experts
- Video footage from public or private sources
Each of these sources of evidence is time-sensitive: video may be recorded over and lost, and experts may have busy schedules that we need to work around.
Starting your case right away increases the chance that critical evidence will be preserved for your legal use.
Our Fort Lauderdale Lawyers Will Seek Compensation For Your Losses
If you qualify for damages, our team will fight for every form of compensation you deserve under Florida law. This may include:
- Medical expenses: Hospital stays, surgeries, medications, and physical therapy can add up quickly in Fort Lauderdale. We pursue coverage for both current bills and future treatment you may need.
- Vehicle repair or replacement costs: Whether you need extensive repairs or a rental car while your vehicle is in the shop, we will seek reimbursement for your out-of-pocket expenses.
- Lost income and benefits: If your injuries keep you from working, we fight for the wages, benefits, and even reduced future earning capacity caused by your accident.
- Pain and suffering: Serious injuries bring physical pain as well as emotional anguish. Compensation acknowledges what you and your family have endured.
- Reduced quality of life: You may no longer be able to enjoy simple activities—whether that’s spending time outdoors, exercising, or enjoying South Florida’s beaches and community events.
- Temporary or permanent disability: If your ability to work, drive, or care for yourself has been compromised, we ensure these lasting effects are reflected in your claim.
- Loss of consortium: When an injury damages your relationship with your spouse or family, we will pursue compensation for that very real loss.
At Anidjar & Levine, we understand the heavy toll rideshare accidents can take. Our Fort Lauderdale rideshare accident lawyers will take on the insurance companies and legal system so you can focus on your recovery with peace of mind.
What if the Rideshare Accident Was Fatal? You Can Pursue Damages
Florida Highway Safety and Motor Vehicles (FLHSMV) keeps track of how many accidents occur in the state every year. In 2024, out of 38,333 Broward County traffic accidents, 218 resulted in fatalities.
If you want to file a lawsuit on behalf of a deceased loved one, Anidjar & Levine can help. We assist clients with wrongful death cases by:
- Explaining the differences between personal injury and wrongful death cases, including the differing statutes of limitations
- Managing all communications with claims adjusters, defense lawyers, and other involved parties
- Calculating how much you can recover in compensation for things like loss of financial support, funeral expenses, and loss of companionship
- Determining who is responsible for your loved one’s passing
- Negotiating with the liable insurance company for a fair settlement
- Filing a lawsuit against the negligent party
- Protecting you from unresponsive or aggressive claims adjusters
On behalf of our entire team, we are deeply sorry for your loss. We want to ensure that your family receives both the justice and compensation you deserve from all liable parties.
How Long Do You Have to File Your Potential Uber and Lyft Accident Lawsuit?
According to Florida Statutes § 95.11, you are only entitled to compensation if you file your lawsuit within two years of the accident date. Unless an exception applies to your case, the Florida legal system will not consider your case. This is one reason why contacting an attorney from our firm as soon as possible is a good way to protect your rights.
In most cases, once the statute of limitations has passed, it is impossible to recover any damages. Our law firm can determine how much time you have to act under the statute of limitations. If you do not file your case on time, you risk losing the chance to recover compensation.
