Legal Guidance for Victims of Devastating Accidents in West Palm Beach
Serious or catastrophic injuries include all events that wreak permanent harm on an accident victim. Often, motor vehicle collisions result in catastrophic injuries. Still, almost any accident is capable of causing devastating harm, such as traumatic brain injury, spinal cord damage and paralysis, amputation, multiple broken bones, and disfigurement. Permanent injuries can necessitate the need for lifelong care, vocational rehabilitation, special medical equipment, and other significant damages. The knowledgeable injury attorneys at Anidjar & Levine can counsel residents of West Palm Beach and the surrounding cities who have been involved in a devastating accident. Assert Your Right to Damages through a Negligence Claim
If you have severe and permanent injuries after an accident, it may be crucial to retain an attorney who is experienced in handling these cases. It is important to make sure that all the responsible parties are brought into the case to provide the greatest possible chance of recovery, since medical bills and care for catastrophic injuries can be expensive.
For example, in a truck accident case, an attorney can look at whether the driver’s employer bears any responsibility for the accident. A trucking company usually carries a larger amount of liability insurance coverage, which means that in the case of a catastrophic injury, you may have a greater chance of actually recovering the damages you need if you are able to bring in both the truck driver and his or her employer.
Florida does not follow the rule of joint and several liability, so each party is responsible only for his or her percentage of fault for an accident. If a responsible party is not named, the defendant can try to prove that party’s fault by a preponderance of the evidence. If he or she successfully shows the accident was entirely a non-party’s fault, no damages can be recovered from the defendant.
Damages that may be sought typically include both economic and non-economic damages. A plaintiff’s economic damages rarely vary much according to the viewpoint of the jury. They include such items as medical bills, out-of-pocket costs, household services, vocational rehabilitation, lost income, and other concrete damages that can be proved with reference to documentation.
However, a plaintiff’s noneconomic damages may vary significantly depending on the judge’s and jurors’ perceptions of credibility and what damages might naturally flow from the catastrophic injuries. Noneconomic damages tend to include pain and suffering and loss of enjoyment. A spouse may be able to recover loss of consortium when catastrophic injuries have been suffered.
