Whether you suffered a neck injury from a collision, fall, or another incident, our team can help. A Naples personal injury lawyer from the Law Offices of Anidjar & Levine can build your case by consulting with experts, investigating, and reviewing your damages.
Many of our cases settle out of court. However, we’re prepared to file a lawsuit if that means securing fair compensation.
Our Lawyers Manage Neck Injury Cases Caused by the Following Incidents
We help injured claimants who have suffered neck injuries due to:
- Car accidents
- Motorcycle accidents
- Truck accidents
- Pedestrian accidents
- Slips, trips, and falls
- Medical malpractice
- Construction accidents
- Workplace incidents
Many of these cases rest on the principle of negligence, meaning that another party’s recklessness, carelessness, or omission caused injuries to another person. We can prove negligence based on the details of your case.
How Much Does It Cost to Partner with Our Team?
Our neck injury lawyers in Naples work on a contingency-fee basis. In this arrangement, our clients pay nothing up front or from their personal savings. We only collect payment if we secure compensation. Even then, our attorney’s fees come from your settlement or court award.

Florida’s Statute of Limitations Affects Your Case
We encourage you to consider your legal actions promptly. Florida Statutes § 95.11(3)(a) limits the time you have to file a lawsuit. You could have four years to file. Some evidence won’t even last a few months. For that reason, we encourage you to consider our services.
What Goes Into Building My Collier County Neck Injury Case?
The following is a rough outline of how our team will build your case:
We will Conduct an Investigation
Earlier, we mentioned that most injury cases rest on proving negligence. We can use the following information to prove that you were hurt:
- The accident report
- Eyewitness testimony
- Your written account of events
- Security camera or traffic camera footage
- Your imaging scans
- Receipts from assistive devices
- Your medical bills
- Information from your healthcare provider
We’re not just attorneys; to some extent, we’re also investigators. The more evidence we can find, the more compelling we can build your case.
We will File Your Insurance Claim and Negotiate a Settlement
Once we identify the liable party, we can file an insurance claim to seek compensation. This requires us to calculate the value of your case. In our calculations, we will consider your:
- Age
- Mobility
- Ability to work
- Financial obligations
- Quality of life
- Pain levels
- Emotional state
- Medical bills and lost wages
Ideally, after filing your claim, the insurer will offer a fair settlement. If not, we can file a lawsuit against the at-fault party.
We will File Your Civil Lawsuit
Filing your lawsuit involves:
- Taking depositions from witnesses
- Crafting your case’s argument
- Managing all court documents and paperwork
- Presenting evidence to supplement your case
- Objecting to unfair motions or questions
- Cross-examining the other party’s witnesses
Our lawyers are confident in their abilities to represent you, either in or out of court. Our goal is to seek a fair outcome for your neck injury case.
Compensable Losses in a Naples Neck Injury Case
The Law Offices of Anidjar & Levine will fight to recover these (and other) losses on your behalf:
Your Past, Present, and Future Healthcare Expenses
Your neck injury may have required:
- Surgery
- Physical therapy
- Assistive devices (like a neck brace)
- Medications
- Chiropractic care
We will consult with your doctors to learn more about the full scope of your medical expenses.
Lost Income
We know that not everyone works a nine-to-five job. So, compensation in your case could account for lost:
- Employee benefits (like insurance)
- Wages
- Tips
- Contracts
- Commissions
- Bookings
- Income
- Hourly rates
We can even pursue the cost of your lost future earning capacity. So, if your neck injury prevents you from making your regular income (either temporarily or permanently), we can seek this expense.
Pain and Suffering
Pain and suffering accounts for the physical pain and emotional trauma of being hurt. The value of this damage depends on various factors specific to your situation.
Disability
A neck injury can reduce your range of motion, cause paralysis, and impair your mental health. We will seek reimbursement that covers your disability-related hardships.
This is not an exhaustive list. Based on your situation, we can pursue other damages not mentioned here.
FAQs About Neck Injury Cases in Naples
We want to provide clarity to an otherwise confusing situation. As such, here are three questions prospective clients commonly ask us:
Should I Accept the First Settlement?
The first insurance offer might be a “test,” checking to see if you’ll accept less than you’re really owed. Insurance companies often cut corners by paying claimants less than they deserve. With our neck injury team, we will assess any settlement offers and fight for one that pays for your losses.
How Long will My Case Take to Settle?
The progression of your case depends on:
- The insurance company’s cooperation
- Your case’s evidence
- How long ago your accident happened
- Whether you reached maximum medical improvement
- The cost of your damages
- The severity of your condition
Our team will keep your case moving forward by all means necessary. If we sense that the liable insurance company is dragging out negotiations, we will move ahead with a lawsuit.
What Happens if the Other Party Says I Caused the Accident?
Florida is a pure comparative negligence state, under Florida Statutes § 768.81. Partially causing your accident does not bar you from seeking damages. It does, however, potentially reduce the amount of money you can seek.
Using your case’s evidence, we will paint a picture of what really happened before, during, and after your accident.
