When a company releases a product into the marketplace, they must guarantee that the product is safe to use. However, a dangerous or defective product can cause harm to a consumer, leaving them with severe injuries, medical expenses, or lost pay from being out of work. If you or a loved one suffered an injury from a defective product, a Melbourne product liability lawyer can guide you through the legal process.
At the Law Offices of Anidjar & Levine, we offer legal services to victims of dangerous or defective products. We can investigate your case, determine what happened, and hold the responsible parties liable for your damages. We offer a free initial case review, during which we encourage you to share the details of your situation with us.

Florida Product Liability Laws
Florida Statute §768.81 grants claimants the ability to pursue legal action if a defective product resulted in any injuries or fatalities. Companies must ensure that the products they design and release to the public are safe to use. If they do not, they could be held financially responsible for any resulting damages.
How much time you have to take your case to court rests on the details of your situation. For example, let’s say that you suffered injuries from a toaster oven that caught fire and burned you. Under Florida Statute §95.11, you would be granted four years from the date you were injured to take your case to court since you can verify the exact date you were injured.
However, let’s say that you were injured by a chemical featured in a product that slowly caused health complications over time. In that situation, you may be granted additional time to act, since your injuries cannot be pinpointed to an exact point in time.

Determining Fault for Your Product Liability Case
Product liability cases can be challenging because there may be multiple parties responsible for your damages.
Negligent parties may include:
The Manufacturer
If a product is defective, the manufacturer may ultimately be to blame. The manufacturer may have assembled the product improperly. If so, we may be able to file a claim against the manufacturer.
The Designer
Manufacturers are not always responsible for designing a product. Sometimes, a product’s design is inherently flawed. This means that an entire line of products could have posed a threat to many different people. If this was the case in your situation, your Melbourne product liability lawyer can advise you on your legal options.
The Shipping Company
A product could have been damaged or altered while on its way to the store. Some items must be stored in specific temperature conditions or must be handled carefully to avoid breaking. If this factor played a role in your injuries, your legal team can determine if the product was damaged in transit, and from there, pursue the cost of your related expenses.
