Proving Liability in a Key West Texting While Driving Accident
Determining who is legally responsible is a critical part of any texting while driving injury case. To obtain compensation, it must be established that the driver breached their duty of care by texting while operating a vehicle and that this distraction directly caused the accident and resulting injuries.
Although texting while driving is both illegal and widely acknowledged as dangerous, insurers often dispute fault or argue that phone use was not the true cause of the crash. These defenses are commonly used to delay or reduce payouts.
A skilled Key West personal injury lawyer will conduct a comprehensive investigation to uncover exactly what happened. Depending on the circumstances, responsible parties may include:
- Vehicle owners who knowingly allowed an unsafe driver to use their car
- Companies that manufactured defective in-vehicle or mobile technology
- Employers, when the driver was texting while performing work-related tasks
- Government entities responsible for dangerous road conditions, inadequate signage, or poor roadway design
Your attorney may rely on evidence such as phone records, police reports, traffic camera footage, eyewitness testimony, vehicle data, scene photographs, and medical documentation. In more complex cases, accident reconstruction professionals or human factors experts may be brought in to show how texting contributed to the collision.
Florida No-Fault Insurance and Texting While Driving Accidents
Florida’s no-fault insurance laws require most drivers to initially seek benefits through their own Personal Injury Protection (PIP) coverage after an accident.
PIP provides limited compensation for medical expenses and lost income, regardless of who caused the crash. However, in serious texting while driving accidents, these benefits are often insufficient.
If your injuries involve permanent disability, substantial disfigurement, loss of bodily function, or if the accident resulted in a death, you may be entitled to step outside the no-fault system and pursue a claim against the distracted driver and other liable parties.
A Key West texting while driving accident lawyer can review your injuries and determine whether you qualify to seek compensation beyond PIP coverage.

No Upfront Legal Fees When You Hire Our Team

By charging our clients in this manner, there are no upfront costs. You only pay legal fees if we recover compensation for you. If your case is unsuccessful, you owe us nothing. This approach allows accident victims in Key West to obtain experienced legal help without additional financial risk.
Time Limits for Filing Texting While Driving Claims in Florida
Florida law sets strict deadlines for filing personal injury and wrongful death lawsuits. In most texting while driving accident cases, you have two years from the date of the crash to file a claim. Wrongful death actions are also subject to a two-year statute of limitations.
Waiting too long can seriously weaken your case. Involving an attorney gives them time to:
- Preserve evidence before it is lost or destroyed
- Obtain cellphone and electronic usage records
- Speak with witnesses while details are still fresh
- Ensure all filings comply with legal requirements
Prompt action can significantly improve your chances of success.
Comparative Negligence in Key West Texting While Driving Cases
Florida applies a modified comparative negligence standard to car accident cases. If you are found partially responsible for the accident, your compensation will be reduced by your percentage of fault. If your share of fault exceeds 50%, you are barred from recovering damages.
Insurance companies often attempt to shift blame onto injured individuals to limit their financial exposure. Our Key West texting while driving accident attorneys push back against these tactics by presenting strong evidence of the distracted driver’s negligence and defending your right to fair compensation.
