A crash with an uninsured driver can leave riders stuck with injuries and uncertainty about who pays next. An uninsured motorcycle accident lawyer in Four Corners steps in when insurance gaps threaten your recovery. At Anidjar & Levine, we have handled these claims across Central Florida since 2005.
Our team works with injured riders, passengers, and families after uninsured and underinsured motorcycle crashes, including hit-and-run cases. A Four Corners motorcycle accident lawyer from our firm focuses on coverage analysis, timing, and proof, not assumptions about fault.
We approach uninsured claims with structure and urgency. That means identifying every available policy, addressing insurer resistance early, and protecting your claim from avoidable setbacks.
How Uninsured Motorcycle Claims Work In Four Corners
Florida does not require motorcyclists to carry Personal Injury Protection, and PIP rarely applies to riders after a crash. When the at-fault driver lacks bodily injury coverage or disappears, a Four Corners personal injury lawyer looks first to uninsured or underinsured motorist coverage for payment.
UM coverage steps into the role of the uninsured or unknown driver and can pay for bodily injury losses up to your policy limits. When the other driver carries minimal insurance, underinsured motorist coverage may address the remaining gap.
Hit-and-run crashes near I-4, US-27, and US-192 regularly qualify as UM claims. These cases demand fast reporting and documentation, since policies often impose stricter proof requirements when the at-fault driver remains unidentified.
What We Do For Your Four Corners UM Case
We take on the insurance process so you can focus on healing. Our Four Corners uninsured motorcycle accident attorneys handle evidence, deadlines, and negotiations while you receive care.
Here is how we move your uninsured motorcycle accident claim forward:
- Gather police reports, scene photos, and witness statements
- Secure medical records, bills, and wage documentation
- Analyze all policies for UM/UIM, stacking, and exclusions
- Prepare and file notices, sworn proofs of loss, and demand packages
- Coordinate statements and independent medical examinations
- Negotiate for policy limits and file suit when payment is delayed or denied
Each step builds leverage. Organized proof, timely filings, and consistent pressure place the claim in a stronger position before negotiations or court involvement begin.

Coverage Questions: UM, UIM, And Stacking In Florida
Your options depend on the policies in your household. Florida UM/UIM is optional, but many riders add it to protect against uninsured drivers common in the Four Corners area.
Some policies are “stacking,” which can multiply limits across vehicles; others are “non-stacking,” which keep you to a single limit. We read the declarations, endorsements, and exclusions to identify every source of recovery available to you.
Stacking Versus Non-Stacking Policies
Stacking UM allows you to combine limits for each insured vehicle, which can raise available coverage for a serious injury. Non-stacking UM limits you to one set of limits, but you may still access resident-relative policies depending on the policy language.
We also look for umbrella policies, medical payments coverage, and collision coverage for property damage. While UM pays for bodily injury, your motorcycle repairs typically run through collision coverage or the at-fault driver’s property damage liability if it exists.
Damages Available In A Four Corners Uninsured Motorcycle Case
UM benefits cover bodily injury losses such as medical expenses, lost income, and pain and suffering. Florida motorcyclists are not bound by the no-fault injury threshold, so you may claim full human damages if the other driver was at fault.
In wrongful death cases, surviving family members may recover damages allowed under Florida’s Wrongful Death Act, subject to policy limits. We present proof of loss through medical evidence, employment records, and testimony about your daily life.
UM does not pay for property damage to your bike. For repairs or a total loss, we look to collision coverage or the at-fault driver’s property damage liability if that coverage exists.
Florida Deadlines, Notice, And Claim Steps
Florida’s statute of limitations for negligence claims is generally two years, and wrongful death is generally two years. A UM claim is a contract claim, which commonly carries a longer deadline, but policy notice requirements apply much sooner.
We recommend reporting the crash to the police and your insurer right away and seeking prompt medical care. Insurers often require a recorded statement and may request an independent medical exam; we prepare you and attend when permitted.
Many UM cases resolve through pre-suit negotiations. If the insurer does not pay fairly, we file suit in the proper court and move the case toward a resolution through litigation or settlement.
Disputes With Insurers And Our Litigation Approach
Common disputes include low offers, causation challenges, arguments about fault percentages, and policy exclusions. Florida follows a modified comparative fault rule, so your compensation can be reduced by your share of fault, and recovery is barred if you are found more than 50% at fault.
Our uninsured motorcycle accident attorneys in Four Corners counter these defenses with crash reconstruction, medical opinions, and wage loss analysis. When the insurer delays or underpays, we file suit to enforce the contract and seek fair value within policy limits.
If the at-fault driver carried some coverage, we coordinate third-party and UM claims to avoid gaps or offsets. Our goal is to place the maximum available insurance on the table and document every dollar of loss.
What To Do After An Uninsured Motorcycle Crash In Four Corners
Your actions early on can shape the claim. Focus on health and preserving proof while we handle the insurer.
Take these steps as soon as possible:
- Call 911, report the hit-and-run or uninsured driver, and request an officer
- Get medical care the same day and follow treatment plans
- Photograph the scene, your bike, and your injuries
- Gather witness names, camera locations, and nearby business details
- Save gear, helmet, and parts for inspection
- Report the crash to your insurer but avoid detailed statements without counsel
These steps protect evidence and timing. Strong documentation from the start reduces disputes later and places the claim on firmer ground as coverage questions arise.
