Beneficiaries Of A Wrongful Death Claim In Dupont, Florida
If a wrongful death lawsuit is appropriate, Florida requires the deceased’s personal representative to be the one to file it. Should the deceased’s will not name a personal representative, the court assigns one. This person may or may not be a beneficiary as well.
Beneficiaries may change, depending on the case, but Florida typically allows the following survivors to recover compensation for wrongful death:
- Spouse
- Children, depending on age and state of dependency at the time of the loved one’s death
- Siblings or other relatives who were dependent on the deceased at the time of death
The Dupont wrongful death lawyers at our firm can work with the personal representative in your case to fight for the damages that each member of your family needs and deserves.

Proving Negligence In A Wrongful Death Case
A wrongful death claim must be supported with proof of negligence or wrongdoing. For example, if your loved one passed away after an auto accident, our Dupont car accident lawyers can find proof that:
- The defendant (often a driver) had a duty of care to follow traffic rules and not harm your loved one
- The defendant breached that duty of care by violating the speed limit, running a red light, or ignoring some other rule of the road
- The driver’s negligent actions caused your loved one’s death
- Your family suffered losses from the death of your loved one
Our Dupont attorneys can help you determine who caused your loved one’s death—and, therefore, who owes you damages.
