We Fight for Compensation No Matter the Cause of Your Spinal Cord Injury.
No matter the cause of your spinal cord injury, a good chance exist that another party was partially or fully responsible. We have helped clients win settlements for many types of spinal cord injuries. Our process works. We evaluate your case thoroughly, identify all responsible parties, and then use our extensive resources to gather evidence against them and build a case.
Here are some of the most common causes of spinal cord injuries, according to 2017 data from the National Spinal Cord Injury Statistical Center (NSCISC).
Vehicular
Over 38 percent of spinal cord injuries resulted from vehicle accidents, making this the most common cause of injury to the spine. Responsible parties in a vehicle collision might include the other driver, the vehicle manufacturer, or—in a situation where a traffic control device malfunctioned—a state or local government.
Falls
Accounting for over 30 percent of occurrences, falls represent another major cause of spinal cord injuries. They often occur on someone else’s property, such as at a business or private residence. If the owner or manager of the property knew about the hazard but failed to correct it or warn you of it, they could be liable for your injuries.
Violence
Violent acts account for over 13 percent of spinal injuries. Gunshots, stabbings, and physical assaults cause thousands of injuries to the spine every year. If your injury occurred as the result of violence, we can pursue the responsible party for punitive damages on top of any other compensation for which you are eligible.
Sports and Recreation
Sports and recreation cause nearly 9 percent of injuries, representing a major risk for spinal trauma. Contact sports, such as football and lacrosse, and extreme activities, such as bungee jumping, pose an especially high danger. Even if you signed a waiver, it does not necessarily absolve the other person of responsibility. Our attorneys can examine the situation and determine if you have a case.
What Damages Can I Recover After a Spinal Cord Injury?
Recovering from a spinal cord injury is not only a long and sometimes painful process; it can also be very costly, as well. If you are not prepared and do not know your rights, it can ruin you financially.
The NSCISC has estimated that a 25 year old who suffers the most severe form of spinal cord injury will spend an average of $4.7 million on medical bills and rehabilitation during their lifetime. If another party’s negligence caused your injury, they should be footing the bill, not you. Our attorneys see to it that whoever is responsible is the one that pays.
When we take on your case, we pursue all damages for which you are eligible. After a spinal cord injury, that may include the following.
Medical Bills
Medical bills from a spinal injury can be exorbitant. The average patient requires an 11-day hospital stay, plus 35 days of rehabilitation once they get out. Nearly one-third of spinal injury patients return to the hospital within a year, triggering even more costs. Not to mention, severe spinal injuries can require you to undergo therapy and rehabilitation for years, even for the rest of your life. Our attorneys seek compensation for both current and future medical bills.
Lost Wages and Earning Capacity
If your spinal cord injury causes paralysis, restricted mobility, or muscle weakness, you may find it difficult to continue working. Even if you can return to work eventually, you will probably have to take time off for treatment. Our attorneys pursue the responsible party for your lost wages and reduced earning capacity.
Pain and Suffering
Money cannot erase the pain of your injury, but it can prevent financial stress from making a bad situation even worse. That is why we fight for the maximum damages available for your pain and suffering.
Punitive Damages
If the responsible party showed malice in their actions—for instance, you were the victim of a physical assault—or exhibited not only negligence but a reckless disregard for your safety, we can seek punitive damages on top of all other compensation. The courts award these in extreme cases as a way to punish the responsible party.
