Who is Responsible for My Spinal Cord Injury?
Spinal cord injuries have many causes, but a common thread is that someone other than the injured party often shares in the responsibility. That is why it is so important to contact a qualified attorney as soon as possible after an injury. The more time that passes, the more difficult it can be for us to gather evidence from the injury scene and demonstrate another party’s liability.
The party or parties liable for your injury will depend on how it occurred.
Vehicular Accidents
Motor vehicle crashes are a common cause of spinal cord injuries. If you injured your spine after a car accident, we can examine the circumstances surrounding your crash to determine where fault lies. Through gathering police reports, witness statements, and other evidence, we can build a case against the responsible party or parties. Even if you share liability in the crash, we can still potentially pursue another party for damages.
Falls
Falls are another common cause of spinal cord injury. Often, these falls occur on someone else’s property, such as a business, private residence, or public domain. Under premises liability laws, property owners have a duty of care to protect others from potential hazards. We survey the property where your fall occurred and determine what hazards existed and whether the property owner provided sufficient warning. We will gather evidence in the form of photos, surveillance video, eyewitness statements, and expert witnesses to build our case. If we find that another party is liable, we pursue them aggressively for the max damages.
Violence
Intentional acts of violence often have devastating effects for victims. Gunshots, stabbings, and assaults all have the potential to cause spinal damage. If you were the victim of violence, we can pursue the perpetrator for compensation, including punitive damages.
Sports and Recreation Accidents
If your injury resulted from a contact sport, such as football, or from an extreme activity, like bungee jumping or mountain biking, we can help you determine if another party is responsible. We can examine any contracts or waivers you signed prior to the activity, present medical records, talk to witnesses, and bring in experts in the field to help bolster our case.
What Damages can I Recover After a Spinal Cord Injury?
Spinal cord injury victims incur many costs. Our goal is to help you get compensated for all of them.
According to the National Spinal Cord Injury Statistical Center (NSCISC), the average lifetime cost for a person suffering the most severe category of spinal cord injury at age 25 is over $4.7 million. That is why you need the most experienced and aggressive lawyers fighting for compensation on your behalf.
We will pursue a variety of damages in your case.
Medical Bills
The average hospital stay following a spinal cord injury is 11 days and the average patient requires 35 days of rehabilitation following their hospital stay. Moreover, 30% of patients return to the hospital at some point during the ensuing year. These bills can be astronomical, which is why we fight to ensure the responsible party or parties pays them.
Lost Wages and Earning Capacity
Unfortunately, many spinal cord injuries result in permanent damage. If your ability to work and earn a living decreases due to your injury, we can seek compensation to make up for this lost income. This applies to both current and future earnings for the remainder of your working years.
Pain and Suffering
Recovering from a spinal injury can be a painful, harrowing process. While no amount of money can take the physical and emotional pain away, you deserve additional compensation for having to go through it. As your attorneys, we pursue every dollar on your behalf.
Punitive Damages
In certain cases, we can even pursue the responsible party for punitive damages. Courts award this compensation when they determine that the responsible party went beyond simple negligence and acted in a malicious manner that resulted in your injury. We examine your case to determine if you might be eligible for punitive damages.
