While insurance companies are required by law to provide compensation for valid claims filed under insurance policies, often negotiations with the insurance companies prove challenging and complex. Knowing the process for property damage claims can help you understand how your claim should be processed, and what your options are if your property claim is denied. Contacting a property claim lawyer in Davie, FL, from the Law Offices of Anidjar & Levine can help you understand the process of filing a claim, negotiate with the insurance companies on your behalf, and assist you if your claim has been denied.
Property Claims
Property claims can be made if your home or property suffered losses due to wind, water, flooding, hurricanes, tropical storms, pipes bursting, or fire. Florida homeowners face unique challenges as the state seems to be constantly dealing with catastrophic weather disasters. However your losses occurred, it is important to note that you may have a right to receive compensation under your insurance policy for any covered property losses.
Process for Filing a Property Claim
The process to file an insurance claim for property losses can be overwhelming. Understanding how the process typically works can help you understand your rights and your obligations as a property owner. A property claim lawyer in Davie, FL, from the Law Offices of Anidjar & Levine can review your case, explain your legal rights, and help you through the process of filing your claim.
Notice of Loss
As a property owner, you will be required to contact your insurance company after a weather-related event or accident that caused your property loss. You will be required to provide notice to your insurance company as soon as possible. Many insurance policies have a deadline by which you need to provide notice regarding a covered property loss. Attempting to make a claim after this deadline could make your claim invalid.
Protection Against Further Loss
You have a responsibility as a homeowner to take reasonable measures to protect your property from any further damage. For example, if a hurricane or tropical storm damaged part of your roof, you must attempt to cover the area that is damaged to protect the interior of your property and any interior property and belongings from further losses. While reasonable measures could be subject to interpretation, you should visit with your insurance company regarding what their standards are regarding different accidents and weather-related events that cause losses. Failure to protect your property against further losses could negate your ability to receive compensation for those future losses.
Proof of Loss
After you notify your insurance company regarding an accident or weather-related event that caused home or property loss, the insurance company will need you to submit a proof of loss statement. This statement is a formal identification of your property losses and is signed under penalty of perjury. You must include everything you would like your insurance company to cover, including completely destroyed property, to other incidental issues such as mold cleanup in your home. Typically, insurance companies require that you submit this itemized list within 60 days after their request. Failure to provide an itemized proof of loss statement could prevent you from receiving compensation under your insurance policy.
