Being injured on the job is one of the worst things you can experience as a professional. You want to work and earn a living, but when a work-related injury prevents you from working, the rest of your life doesn’t stop. Your landlord and creditors don’t care if you can’t work. That’s why having a workers’ compensation claim denied can come as such a shock. At times like these, a Brandon workers’ compensation lawyer can help.
The Law Offices of Anidjar & Levine has been helping people in your situation for years. We have a proud history of fighting for our clients against insurers, and we’re ready to fight for you too. You have rights in the workers’ compensation process, but you may now know how to exercise them. Our Brandon personal injury law team wants to help you do exactly that.
Why Would A Workers’ Compensation Claim Be Denied?
According to the Florida Department of Financial Services, most employers with four or more employees in Florida must have workers’ compensation insurance. On the plus side, this insurance keeps your employer from going out of business due to paying for employee injuries.
On the downside, insurance companies don’t make money by paying out claims. In fact, it’s just the opposite. Every claim they deny or minimize the value of results in more profits for the workers’ compensation insurance carrier. Obviously, they can’t deny your claim on those grounds, but they may use other excuses to deny your claim, such as:
- You didn’t sustain your injuries at work
- Your injuries are the result of you “horsing around” on the job or some other improper/prohibited activity
- Your injuries are not severe enough to cause you to miss work
- You sustained your injury while intoxicated
- You injured yourself on purpose
A Claim Denial Is Not The End Of The Road
You have options if you feel your claim was wrongly denied. Remember, the workers’ compensation insurance company doesn’t want to pay your claim. Even if they do, they may try to pay you as little as possible. We believe there is an inherent conflict of interest in an insurance company with a financial incentive to deny your claim deciding the legitimacy of that claim.
A Brandon workers’ compensation lawyer from our firm can look at the circumstances of your claim through another perspective that prioritizes your wellbeing instead of insurance company profits. You have the right to file an appeal against any workers’ compensation claim denial. A workers’ compensation lawyer from our firm can help you file that claim and fight your case!
If the appeal doesn’t work, the fight still isn’t over. Our workers’ compensation lawyers are always with you until the end. We’re not in this to book a quick settlement, cash a check, and move on. We’re in this for you! If that means going to court to get what you deserve, we’ll do just that. So, never forget—the denial of your claim is just the beginning, not the end of the process!
