Potentially Recoverable Compensation After a Drunk Driving Accident
The exact amount of compensation that is available will be different in every case. However, drunk driving victims are often able to pursue damages that include:
- Immediate medical costs, such as emergency room care and surgeries
- Ongoing medical care costs, including physical therapy and prescription medication
- Pain and suffering
- Damage to your vehicle
- Lost wages for the time you spent out of work to recover from your injuries
- Reduced earning capacity for the way your injuries will affect your ability to perform at work and earn an income
- Loss of quality of life if your injuries prevent you from engaging in the activities you once enjoyed
- Scarring and disfigurement
These are not the only forms of compensation you may be able to recover. When we take your case, our Boca Raton car accident lawyers can help guard your rights to pursue the damages you deserve.
Wrongful Death Compensation
If a loved one passed away after the accident, we can pursue a wrongful death claim or lawsuit to recover damages for funeral and burial expenses, loss of future income, loss of consortium, and more. Your loved one’s medical bills and pain and suffering may also be applicable forms of compensation in your wrongful death case.
While you and your family mourn your loved one and grieve in peace, we can handle the entire legal process of pursuing fair compensation.
Drunk Driving Accidents Can Lead to Severe Injuries
According to the National Highway Traffic Safety Administration (NHTSA), 10,142 people died in 2019 due to drunk driving. Aside from fatalities, an accident involving a drunk driver can result in serious injuries that require both immediate and ongoing medical care.
Some of the injuries that can result from these accidents include:
- Fractures
- Loss of limbs
- Traumatic head injuries (TBI)
- Spinal cord injuries
- Internal bleeding
- Organ damage
- Lacerations and bruises
- Hemorrhaging
- Post-traumatic stress disorder (PTSD)
Severe injuries can quickly cripple a family, both financially and psychologically. You may require multiple surgeries, years of rehabilitation, and home modifications to cope with your injuries. You do not deserve to suffer due to a preventable accident. Our car accident attorneys can advocate on your behalf to help you recover compensation.
We Help Victims of Drunk Driving Accidents in Boca Raton
Drunk driving accident victims may experience a combination of psychological and physical distress that can leave them struggling to cope. Financial stress can mount if your injuries prevent you from working during your recovery, as well.
Our team can discuss your legal options for compensation. Once you know your rights, you can make an informed decision on how to proceed with your case. Our drunk driving accident lawyers can guide you through the process while you concentrate on getting better.
We Can Demonstrate the Drunk Driver’s Negligence in Your Case
Driving under the influence of drugs or alcohol is illegal, per Florida Statute § 316.193. A violation of this law may be enough to prove negligence in your case, but our lawyers will go the extra mile to demonstrate exactly how a drunk driver’s decision led to your accident and injuries.
For example, drunk driving often leads to poor judgment calls, delayed reactions, and speeding. If a drunk driver hit you after swerving out of their lane, they would be liable for your losses.
Our personal injury lawyers can investigate your accident to collect the necessary evidence to hold the negligent driver liable for your losses. We may use police reports, previous convictions, and eyewitness testimony to bolster your case.
We Can File an Insurance Claim
We may begin seeking compensation by filing an insurance claim. When we handle your claim, we take on all of the communications with the insurance adjusters and the liable party. This way, you do not have to worry about making any statements that would compromise the value of your claim.
Regardless, insurers may undervalue or deny your claim, and we can step in to negotiate a fair settlement. We can present our determination of fault, as well as the evidence of your losses and how they will affect your life going forward. Often, insurers make an initial offer that does not consider the full scope of your injuries, and we will fight to account for your future losses.
This way, you won’t be left footing the bill for your recovery years later. Our aim is for your settlement to accurately reflect your losses, and we want to protect you from suffering any further due to your drunk driving accident in Boca Raton.
We Can File a Personal Injury or Wrongful Death Lawsuit
When negotiations with insurers fail, our injury lawyers will not hesitate to take legal action on your behalf. We can file a lawsuit and pursue a court-awarded offer. A drunk driving accident lawyer from our firm can handle all of the paperwork and communications with the defendant and their legal team throughout the process.
You Have a Limited Time to File a Lawsuit
It is important to act quickly so that your legal team has ample opportunity to build a strong case on your behalf. Sometimes, an insurance claim results in a fair settlement offer, but if it doesn’t, you should know that you do not have forever to file a lawsuit.
Per Florida Statutes § 95.11, personal injury cases and wrongful death cases must be filed within a certain time, starting from the date of the accident or death. As long as you call us in time, our team can ensure all the necessary paperwork is filed within these guidelines to preserve your right to seek compensation.
