How a Sarasota Pedestrian Accident Lawyer Can Help You
Filing a claim in the Florida legal system involves a complex process of filling out paperwork, providing documentation, and meeting deadlines. This may be difficult for you to complete on your own, so our team is here to handle it for you so you can focus on your recovery.
We will start by investigating your case and working with you to establish your goals so we can effectively manage each step on your behalf.
Gather Evidence to Prove Liability
If you wish to seek financial awards from the driver in your pedestrian accident case, your lawyer will collect the appropriate information to help prove fault in your case. These items may include:
- Police reports
- Medical records
- Financial statements
- Video surveillance
- Cell phone records
- Sobriety tests
In some cases, both parties are liable for a certain portion of the accident. Thankfully, Florida Statute § 768.81 maintains pure comparative fault, allowing victims to pursue compensation from the other party even if they have shared liability for the accident.
File Your Claim Before Time Runs Out
Even victims of pedestrian accidents and their surviving loved ones who qualify for financial recovery have a certain amount of time to file their claims against the other party. Florida Statute § 95.11(3)(a) sets the statute of limitations on personal injury claims at four years from the injury date.
Florida Statute § 95.11(4)(d) allows personal representatives of deceased victims’ estates up to two years to file wrongful death claims. Our lawyers can calculate how much time you have to file your pedestrian accident claim, so you do not miss your chance to seek compensation for your injuries.

Manage All Communication with Insurance Adjusters for You
When it comes to handling claims, insurance adjusters often make it seem like they care about the victims. Unfortunately, their approach is a tactic they use to distract victims because they care more about the company’s profit than providing compensation for those who need it.
A Sarasota pedestrian accident lawyer can alleviate the stress of dealing with adjusters by communicating with insurance companies for you and negotiating a fair settlement for your injuries or loss. Many pedestrian accident cases settle out of court, but if we cannot achieve a fair amount of compensation for you, we will take your case to court to fight for adequate financial recovery.

Pedestrian Accidents in Sarasota
According to the Governors Highway Safety Association (GHSA), more than 6,500 pedestrians lost their lives in accidents throughout the United States in 2019. The agency notes that while technology has made vehicles safer for passengers, it has done nothing to decrease the risk of serious injuries and fatalities to pedestrians involved in traffic collisions.
A few factors have contributed significantly to this alarming trend, including pedestrian accidents’ location and circumstances. Researchers found that more pedestrians suffer severe or fatal injuries in collisions on local roads without intersections at night, suggesting the need for better infrastructure.
Also, driver behavior such as speeding and distracted driving plays a major role in the frequency of pedestrian accidents. According to the Florida Department of Highway Safety and Motor Vehicles (FLHSMV), 140 pedestrian accidents occurred in 2020 in Sarasota County.
Injuries in Pedestrian Accidents
While pedestrian injuries vary, those most affected include children and elderly individuals. Both of these demographics are frailer than the average adult, and therefore more susceptible to serious injuries.
The most common injuries adults suffer are those to the lower extremities, head, and upper body, which vary in severity depending on the collision’s speed.
