Anything that distracts a driver and takes their focus off the safe operation of their vehicle could lead to an accident. If you or someone you love was injured in a collision caused by a driver who was texting, you could have the basis of a personal injury insurance claim or lawsuit. At the Law Offices of Anidjar & Levine, we will review your case at no cost and listen carefully to your version of events.
Our Miramar texting-while-driving car accident lawyer will identify the at-fault driver and collect evidence that they were texting when the collision occurred. We also assess the financial impact of the accident and negotiate a financial settlement. We handle the insurance company and the details of building your case for you so you can concentrate on your physical and emotional recovery.
Our Distracted Driver Can Be Held Accountable For Your Financial Recovery
The aftermath of a car accident can be costly in more ways than one. Our Miramar car accident lawyer can help you assess your financial damages and recover compensation for the following:
- Medical bills including rehab, therapy, medications, assistive devices, and treatment-related travel expenses
- Lost income including full and part-time employment, freelance and consulting income, and full or partial business income
- The costs of restoring your vehicle to its pre-accident condition or replacing it if it is declared a total loss
You could also be entitled to recover non-economic damages which can include compensation for lasting physical impairment, disfiguring injuries, and physical and emotional pain and suffering. We create a detailed list of your recoverable damages and make sure none are overlooked or omitted.
Recoverable Damages For The Families Of Distracted Driving Fatalities
The loss of a loved one can leave your family reeling and unsure of what to do. You have our heartfelt condolences and our commitment to recover damages for your family. We know nothing can atone for your loss. We also know your family is entitled to recover the following wrongful death damages:
- Funeral and burial expenses
- Loss of financial support
- Loss of household contributions
- Loss of consortium and society
- Loss of companionship and guidance
The state limits the family members who can take these legal steps. We take time to explain the steps involved in a wrongful death action and which family members can benefit from any resulting financial award.
Your Miramar Car Accident Has A State-Imposed Timeline
In Florida, you have a limited time to file a lawsuit against the at-fault driver. Most cases like yours are settled out of court. To ensure you can go to court if a settlement agreement cannot be reached, our car accident attorney will meet the following filing deadlines:
- Florida Statutes § 95.11(3)(a) which generally gives you up to four years from the date of the accident to file your personal injury lawsuit
- Florida Statutes § 95.11(4)(d) which generally gives your family up to two years from the date of a loved one’s passing to file its wrongful death lawsuit
Complying with the statute of limitations can be challenging since many factors can cause it to change. Our familiarity with state and local law can ensure an accurate interpretation of the filing deadline. With enough notice from you, we can also ensure your lawsuit is filed within the allotted time.
Our Investigation Will Prove The At-Fault Driver Was Texting
Distracted driving is on the rise in the state of Florida. Sadly, Florida Department of Highway Safety and Motor Vehicles (FLHSMV) data cites the highest number of distracted driving fatalities in the state in eight years at 333. Proving the at-fault driver was texting proves the following legal elements of negligence:
- Duty of care
- Breach of duty
- Causation
- Damages
Our texting-while-driving car accident lawyer serving Miramar will collect the range of evidence that proves these elements. Doing so on your own can be difficult while you are coping with your car accident injuries and the recovery process.
