What to Do After a Car Accident
When you are in a car accident, there are a lot of things to consider. It is important to remember to:
Get Medical Attention
If you did not receive medical attention at the scene, be sure to get checked out by a doctor as soon as possible. In some cases, injuries do not manifest for days or even weeks after an accident. By going to the doctor immediately after your accident, you are able to tie your injuries to the crash.
Also, be sure to follow your doctor’s orders. If you fail to do so, the insurance company may claim you are exaggerating your injuries.
Write Down Your Account of the Accident
It is also helpful to write down your memory of how the accident occurred as soon as you can before you forget any important details.
Avoid Speaking with the Insurance Company
When you call your insurance company to let them know what happened, just give the facts (time of day when the crash happened, location, type of accident). If you are unsure about the correct way to speak with your insurance adjuster, your Maitland car accident lawyer can help. If you speak with the other driver’s insurer, refuse to give a recorded statement and instead direct the insurer to speak with us.
What You Need to Know About Florida’s Motor Vehicle Insurance Laws
Florida is a no-fault insurance state. This means that your own insurance will cover you if you are injured in an accident regardless of whose fault the accident was. Your personal injury protection (PIP) insurance also covers your family and members of your household if they do not own their own motor vehicle and have their own PIP. FL § 627.736 requires drivers to carry a minimum of $10,000 in PIP coverage.

Why You Should Hire a Car Accident Lawyer
Your PIP only provides $10,000 in coverage. However, if another party caused or contributed to the accident, you may be able to hold them liable for the remainder of your damages. You may want to contact a lawyer to help you file your claim.
The Party’s Insurer Will Likely Not Make the Process Easy for You
Insurance companies have a team of professionals working for them to handle car accident claims. When their insurance adjuster is evaluating the amount of damages your car has sustained and the severity of the injuries you have sustained, they are attempting to save the insurance company as much money as possible. In many cases, the settlement amount they offer will be insufficient to cover your injuries and damages.
Without an attorney working for you, you may spend countless hours trying to get the insurance company to offer you what you deserve. When you hire an attorney, they will negotiate with the insurance company for a settlement amount that will be enough to cover your damages. You don’t need to do anything. If a fair settlement amount is not reached through the negotiation process, your attorney will be prepared to take your case to court.
Damages You Can Recover in Your Accident
A Maitland car accident lawyer will investigate your case and gather all the evidence related to your accident. They will help you determine the responsible parties and what your recoverable damages may be from the accident. These damages may include:
- Your current medical expenses such as the cost of treatment, medical devices, rehabilitation, prescription medication, transportation to and from medical appointments, and other medically related costs that you have incurred;
- Your future medical expenses;
- Your current and future lost wages if your injuries have prevented—and will continue to prevent—you from returning to work;
- The cost of hiring household help if you cannot perform your regular housekeeping duties;
- Childcare expenses;
- The loss of personal property; and
- Vehicle repair and rental car.
You may also be eligible to receive compensation for:
- Mental anguish
- Physical pain
- Disfigurement or scarring
- Loss of consortium

Do Not Wait to Call a Maitland Car Accident Lawyer
The statute of limitations for filing a car accident case is generally four years from the date of the incident under FL § 95.11. However, it can take a long time to compile evidence and witness testimony, hire expert witnesses and accident reconstruction experts, and get the necessary medical paperwork and documentation to build a case.
Most personal injury attorneys work on a contingency fee basis, meaning that you do not pay your attorney anything upfront when you hire them to represent you. Personal injury attorneys will take a percentage of the final settlement amount you are awarded at the conclusion of your case.
