Recoverable Damages in a Key Largo, FL Hurricane Damage Claim
In general, your homeowner’s insurance policy should provide coverage for much of the damage your home receives during a hurricane. Unless there is specific verbiage that excludes hurricane damage, you should be able to recover a payout if damage occurred because of:
- Wind
- Hail
- Downed trees
- Downed power lines
It is important to note that homeowner’s policies generally do not include flash floods or other flooding related to a storm surge. Flood insurance is available through the National Flood Insurance Program (NFIP), sometimes called NFIP insurance or FEMA insurance. If you carry this type of coverage, we can help you file those claims, as well.
What Homeowner’s Insurance Typically Covers
Some of the most common damages that your homeowner’s insurance will likely cover following a hurricane include:
- Roof repair or replacement
- Replacement of broken windows
- Repair of structural damage to buildings from wind or downed trees
- Garage, shed, or fence damage repair
- Siding damage replacement or repair
- Repair or replacement of doors and garage doors
- Remediating damage that occurs because of a leaking or missing roof
- Replacement of spoiled food following a long power outage
When we meet to discuss your case, our team will conduct an in-depth review of your insurance policy and its coverage. We can help you understand not only what your policy covers, but how your deductible works, as well.
In many cases, homeowner’s insurance providers charge a special deductible for hurricane damage. This may be a percentage of your property value instead of your normal flat-rate deductible.
How Insurers Calculate Your Damages
Another factor that can complicate a homeowner’s insurance claim is how your insurer chooses to calculate your damages. When choosing a policy, homeowners usually have two options: actual cash value and replacement cost value. Your choice of coverage can greatly affect the settlement you receive.
Actual Cash Value
Many homeowners opt for actual cash value policies because they typically lower their premiums. However, this policy may not provide as much coverage. Actual cash value policies pay for the real depreciated cost of your losses as if they were undamaged. This will usually end up being much less than what you originally paid for them.
For example, if your computer was damaged in a hurricane, the insurer will take a look at what it originally cost when you purchased it. Then, the adjuster will calculate how much the exact same computer may be worth today. For example, if it cost $1,500 back in 2015, it may now only be worth $500. Under this policy, a homeowner would have trouble affording a new computer at the current market rate.
Replacement Cost Value
While a policy including replacement cost value may be more expensive, it usually offers better coverage. Under this policy, an insurer pays for the replacement cost of your damaged property. Issues can still arise with this policy, though.
For example, if you need your roof replaced but you failed to make necessary repairs before the hurricane, an insurer may deny coverage for this damage. Similarly, if your house flooded partially because of a leaky roof that existed before the storm, an insurer can deny your claim.
Replacement cost value plans also come with damage caps. An insurer may only pay you 100% of the original cost of the damaged property. With the rate of inflation, you may still have to pay something out of pocket to replace your property. Sometimes, homeowners have to purchase additional coverage for more protection under a replacement cost value policy. For example, extended coverage may allow you to receive up to 150% of the original cost of the damaged property.
Our Attorneys Can Help When Insurers Undervalue Your Claim
Analyzing insurance policies can be difficult. They usually contain lengthy subclauses with complicated jargon. Instead of combing through pages of your policy, our legal team can handle the research.
We can take a look at your homeowner’s insurance policy and determine which method insurers should use to calculate your damages. From there, we can advocate on your behalf if they try to offer you less than what you deserve.
