Filing A Claim Or Taking Legal Action Against A Negligent Motorcycle Rider
Accidents can lead to severe injuries that cause various types of financial losses. Potential compensation can help you and your family put your life back together and access the treatment you need.
You can pursue damages through an insurance claim with your motor insurance provider. If you go through insurance, though, you may not be able to recover certain damages, like pain and suffering.
A Jacksonville car accident lawyer from our firm can speak with your insurers on your behalf and negotiate for a fair settlement. They can also file a personal injury lawsuit or wrongful death lawsuit to seek financial recovery.
Damages You Can Seek In A Jacksonville Motorcycle Rider Negligence Case
If you go through insurance, the damages you can get will likely be limited to financial damages. You can seek recovery for:
- Medical expenses
- Lost wages
- Property damage
If you go through the court system, your damages could include other financially-related damages, as well as physical, mental, and emotional damages. Our lawyers can pursue the following damages:
- Reduced earning capacity
- Pain and suffering
- Impairment or disability
- Mental anguish
- Diminished quality of life
- Lost consortium
Wrongful Death Damages
Through either insurance or the court system, you can seek wrongful death damages if you lost a family member in an accident. Wrongful death damages can include loss of income, funeral costs, and your loved one’s medical bills.

Proving The Motorcyclist Rider’s Negligence
There are several steps our lawyers can take in pursuit of justice and damages in your case. These steps include seeking out and showing evidence of negligence on the motorcycle rider’s part, negotiating with your insurers, and possibly litigating your case. Your lawyer will handle everything involved in each of these steps.
Seeking Out And Showing Evidence Of Negligence
You may be convinced the motorcyclist was negligent and is liable for the incident and your injuries. You could be right, but your lawyer will have to prove it. To do this, your lawyer will seek out evidence from the authorities, witnesses, and other sources to support your case. Such evidence could be the police accident report, a witness’s cell phone photos of the accident scene, and more.
To prove negligence, your lawyer will also have to show your insurers or the court how each of the elements of negligence applies in your case. The elements are the duty of care, breach of duty, causation, and damages. For example, our lawyers may argue that:
- The motorcyclist was supposed to abide by the traffic laws.
- The motorcyclist rode recklessly, such as by riding through a red light.
- The reckless actions resulted in the accident.
- The accident led to your damages.
Negotiating With Your Insurer
During negotiations, your lawyer will demand all of your due damages from your insurer. If they act in bad faith and don’t make a fair settlement offer, your lawyer can threaten to sue them with a bad-faith lawsuit. If this doesn’t convince them to make a fair offer, your lawyer can follow through on the threat and sue.
Litigating The Case
If your lawyer has to sue an insurer or the motorcyclist for your damages, your lawyer will prepare the lawsuit, serve it to the other party, and represent you in a trial, if necessary.
Sometimes, lawsuits settle before ever reaching trial, but our Jacksonville motorcycle rider negligence attorneys will be prepared to present your case before a jury or judge. Before heading to court, your lawyer can even hire an expert, like a motorcycle accident reconstructionist, to testify for your case.
How Else Can My Jacksonville Motorcycle Rider Negligence Accident Lawyer Help?
When you give your case over to a lawyer from our firm, your lawyer will take on every responsibility involved in your case. You’ll be able to focus entirely on health and family matters while your lawyer works your case. To help you focus on those matters, your lawyer can also:
- Schedule your doctor’s appointments for you
- Refer you to an auto repair shop
- Refer you to healthcare providers if you need further care
- Work for you on a contingency-fee arrangement so that you won’t have to worry about upfront costs or fees to start your case
Make Sure You Seek Medical Attention After a Motorcycle Rider Negligence Accident
Your health comes first, and your medical records and bills can serve as key evidence of your accident-related losses. Make sure you seek medical attention as soon as possible, even if you did not require emergency medical care after the accident.
Follow through with your prescribed treatment plan, as well. This will protect you from an insurer that may try to argue that you contributed to your losses.
