You may never forget the shock and chaos of being suddenly T-boned, especially if you were injured in the process. Our Hialeah side-impact collisions lawyers can ensure the other driver doesn’t forget the pain they caused you, either.
By pursuing damages, you can hold the negligent driver accountable, ensuring the other party acknowledges your traumatic experience and you receive compensation.
What Damages Can You Pursue Under Florida Law?
Just hearing the phrase “T-bone crash” conjures up images of totaled cars and serious injuries. This type of accident can exact a heavy toll. Your compensation should therefore be commensurate with the crash’s severity.
That compensation typically comes in three forms:
- Medical costs
- Income losses
- Non-economic damages
Each one recognizes an aspect of your life impacted by the crash, providing funds for what you lost due to the other driver’s actions.
You May Be Able to Pursue Compensation Outside of Your Policy
Florida is a no-fault state, meaning drivers seek payment for accident expenses through their own insurance, regardless of who caused the crash. The required Personal Injury Protection (PIP) covers 80 percent of your medical expenses, up to $10,000 (Florida Statute § 627.736). You must file for this coverage within 14 days of your crash.
Nonetheless, that is only 80 percent of your expenses, and the coverage does not include non-economic damages. If you were seriously injured by a negligent driver, you can pursue this additional compensation through a personal injury lawsuit.
Medical Costs
There is simply less car between you and another vehicle in a side-impact crash compared to other collisions. In fact, a study in Injury Epidemiology concludes that the lack of safety measures for the backseat leaves passengers more vulnerable to injury. This is especially so in side collisions. Yet, regardless of where you were sitting, side-impact crashes are often associated with injury and fatality, which come with a price, including:
- Emergency costs
- Follow-ups
- Imaging tests
- Medical equipment
- Medication
- Rehabilitation
Some of these costs are covered by your PIP insurance. You could have sustained a serious injury and accrued expenses beyond that coverage, though. You could be eligible for additional damages for medical expenses related to the crash.
Medical compensation can also cover future losses associated with the injury. Your settlement should reflect what you have already paid. What you are likely to pay as you heal should also be considered.
Income losses
Did you miss work while recovering? You should receive compensation for the income you lost during your days off. Regardless of if it was three days or three months, you were deprived of those wages because of the other driver.
Like medical damages, you can be compensated for future lost earnings as well. For example, your medical condition could have left you unable to work in the same job. In that case, damages could cover your reduced earning capacity. It could also cover the wages you will lose over your lifetime due to a permanent injury.
Non-Economic Damages
You could be wracked by fear of getting back on Hialeah’s roads, anxious about missing work, or haunted by memories of the crash. If so, our side-impact collision lawyers can seek compensation for those feelings. These are non-economic losses—intangible consequences of an accident.
A Hialeah car accident attorney from the Law Offices of Anidjar & Levine can fight for damages to cover:
- Pain and suffering
- Emotional distress
- Loss of enjoyment
- Loss of consortium
This compensation acknowledges how the injury affected your hobbies, independence, mental health, and intimate relationships. Your own insurance does not cover these damages, so you may have to pursue a lawsuit to obtain them.

We Can Help Establish Negligence
In addition to being a no-fault state, Florida has comparative negligence laws—you may be blamed for part of the accident. This can be a way negligent parties try to avoid paying damages, claiming you played a role in your crash. Your damages are then reduced by your amount of fault.
For example, perhaps you were T-boned at Hialeah Gardens Boulevard and North Okeechobee Road. This was ranked as one of TIME magazine’s most dangerous intersections in the U.S. You could have glanced down at your GPS when another driver ran a light, slamming into you. You might be deemed 20 percent at fault for not paying attention. You could therefore still pursue 80 percent of the damages from the crash.
If you’re unsure of your level of fault and how that affects your possible compensation, our attorneys can explain more.
