We trust physicians and other medical professionals to make us better. It is devastating when a doctor fails to do their job properly and we suffer personal injuries as a result. Sadly, this scenario is more common than most people realize. A 2016 study by a group of patient-safety researchers found that medical malpractice is now the third-leading cause of death in the United States, claiming over 250,000 lives per year. It ranks ahead of Alzheimer’s, strokes, accidents, and respiratory disease.
If you or a loved one suffered an injury due to a doctor’s medical negligence, you might be eligible for compensation. You need the right attorney to ensure your case is successful. According to the U.S. Department of Justice, state courts heard nearly 2,500 medical malpractice cases in the year 2005—and plaintiffs prevailed in fewer than 25 percent of them. However, the few who were successful received large awards, earning an average settlement of $400,000. That is a whopping 17 times higher than the median award in a typical tort case.

How Do I Know If I Am Eligible for Medical Malpractice Damages?
For your medical malpractice case to be successful, we have to show that your injuries—or the injuries or death of a loved one—resulted from a medical professional’s negligence or misconduct. We prove this by demonstrating the following key points.
You Had a Doctor-Patient Relationship With the Provider.
First, we have to establish that you hired the physician to provide you with medical services. This makes you eligible to sue them for malpractice. We establish this relationship using medical records, bills, contracts, and other paperwork, as well as through interviews with the physician and their staff.
The Doctor Exhibited Negligence in the Course of Treating You.
Next, we must prove the doctor was negligent at some point while you were under their care. Our best bet for establishing this crucial fact is through the testimony of medical experts. We work with them to paint a picture to the court of how the doctor should have acted and how their actions fell short of that.
Your Injuries Resulted From the Doctor’s Negligence.
Finally, we have to prove a direct causal link between the doctor’s negligence and your injuries. In other words, we must show that you sustained verifiable injuries and your injuries resulted from the doctor’s negligence, not from something else. We do this through medical records and the testimony of medical experts.
What Kinds of Compensation Am I Eligible for in a Medical Malpractice Case?
As the research mentioned above shows, it is difficult to win a medical malpractice case. However, a winning case usually leads to a big payout that can reach the hundreds of thousands or even the millions of dollars.
Our first goal as your attorneys is to win the case—and we have an exemplary track record of doing just that. Simply winning is not enough for us. We also make sure we pursue the responsible party for every dollar of compensation the law allows. This means going after several types of damages.
Medical Bills
A medical malpractice injury often requires you see other doctors to get the problem fixed. Sometimes, a lengthy hospital stay or surgery is necessary, both of which can cause the charges to accumulate quickly. We pursue the responsible party for both your current bills and those we expect you to accumulate in the future.
Lost Wages and Reduced Earning Capacity
If you have to miss work while you recover from your injuries, we seek compensation to make up for the paychecks you are not earning. If your injuries compromise your ability to earn a paycheck in the future, the responsible party—not you—should take the financial hit. We fight aggressively to make sure that happens.
Pain and Suffering
You deserve compensation for the physical pain of your injuries and any emotional damage you have suffered, such as depression, anxiety, or post-traumatic stress.
Loss of Consortium
Certain medical procedures, such as vasectomies, can cause loss of sexual function on the rare occasion the doctor makes a mistake. In these situations, the spouse of the affected patient might be eligible to receive damages for loss of sexual relations.
Wrongful Death
We pursue a wrongful death suit if your loved one lost their life as a result of medical malpractice.
Punitive Damages
If the medical provider who caused your injuries was not merely negligent but acting maliciously or with gross disregard for your safety, we can pursue punitive damages. A judge orders this compensation to punish the responsible party for wrongdoing, on top of all other compensation for which you are eligible.
