Unique Regulations
If a driver and a company involved in an accident failed to adhere to a state or federal law, the victim might have a strong negligence claim.
If you or a loved one was injured due to a truck driver’s negligence, reach out to a truck accident lawyer to discuss your options.
Insurance Coverage
Since there is a lot at stake for insurance companies, they can likely fight any claims tooth and nail to protect their assets.
Your truck collision attorney can help you determine the full scope of your losses, including economic and non-economic damages, so you can seek the compensation you need to recover physically and financially from your injuries. Damages you may be able to claim include:
- Pain and suffering
- Medical bills
- Lost income
- Emotional distress
- Reduced quality of life
Speak with an attorney specializing in truck accidents to discuss which losses to include in your claim.
Establishing Negligence
Your attorney can gather evidence to determine all at-fault parties. Such evidence may include:
- Photos and video of the accident
- GPS and load tracking data
- Vehicle maintenance records
- Trucking company operating policies
- Communications between the company and driver
- Manufacturer or distributor recalls
Using this information, a Jacksonville truck accident lawyer can reconstruct the accident and identify the root causes. They can determine which parties are fundamentally responsible for the accident and file claims against the appropriate at-fault parties. Your lawyer may file claims against multiple parties once in truck accident cases.
Truck Accident Lawyers
Remember that the insurance carrier and trucking company can try to pay as little as possible for your accident. They can often try to reduce your claim’s value by:
- Shifting the blame
- Implying that you were at fault
- Claiming that your injuries are less severe
- Offering lowball settlements that don’t cover your losses
- Pressuring you to sign a statement or waiver of liability
A truck accident attorney can easily recognize and counter these tactics. Since your attorney represents your interests, they can be motivated to ensure that you receive the compensation you deserve for all your losses.
Florida Statute of Limitations
Per Florida Statutes § 95.11(3)(a), you have a limited time to file a truck accident lawsuit against the at-fault parties. The countdown starts on the date of the accident and can pass quickly while you receive medical treatment and cope with your losses.
Your lawyer can need time to gather evidence, establish fault, evaluate your claim, and submit demands to the responsible parties. They can negotiate with the insurance companies on your behalf to obtain a fair settlement. If a settlement cannot be reached, your attorney can file a lawsuit against the at-fault parties before the statute of limitations.
While most vehicle accident cases settle out of court, there is still a possibility that you can need to take your case before a judge. Reach out to a Florida truck accident lawyer as soon as possible after the accident to avoid missing critical legal deadlines.
