There are exceptions.
You may be able to sue Uber if they get in an accident in Florida if your injuries meet or exceed the state’s “serious injury” standard. You could also file a claim against the company’s $1 million liability insurance coverage if your injuries qualify.

Uber’s One Million Dollar Liability Insurance Requirement
Uber drivers, like all Florida drivers of vehicles with at least four wheels, must carry auto insurance with personal injury and property damage coverage. In addition, Uber must carry a $1 million insurance policy to run in Florida. This coverage plan for passengers and drivers varies in compensation. There are various levels of coverage based on the driver’s availability and activity at the time of the accident.
If the Uber Driver Is Not on the App nor Available to Accept Riders
If you were hurt in an accident with an Uber driver who was using his or her car for personal reasons, the first $10,000 in medical claims would come from your personal insurance. You could file a claim with the driver’s auto insurance or sue for damages if you qualify.
If the Uber Driver Is Available but Without a Rider
You may have access to Uber’s company insurance if the driver is on the Uber app but does not have any riders when the accident occurred. Depending on the extent of your injuries and the driver’s personal liability coverage, you could be entitled up to $50,000 per injury with a cap of $100,000. You could also qualify for a maximum of $25,000 in property damage. However, this added coverage is only available if drivers request it.
If the Uber Driver Is Available and Carrying a Passenger
These conditions might qualify your accident injuries for Uber’s $1 million policy. Uber passengers, other motorists, cyclists, and pedestrians are covered if the Uber driver is on the app and has a rider. Uber also has a $1 million uninsured and/or underinsured motorist policy that protects riders if an uninsured driver strikes them.
