You may be able to recover a settlement in the Roundup cancer lawsuits if you are able to establish your non-Hodgkin’s lymphoma or another cancer is related to your Roundup exposure.
Roundup Cancer Lawsuit Background
Fortune reports that Bayer is facing off against more than 18,000 plaintiffs who say the Roundup herbicide made by Monsanto (a company Bayer purchased in 2016) caused the plaintiffs’ cancer. Juries in several bellwether trials have ruled in favor of the plaintiffs to the tune of millions, even billions, of dollars each.
A class action lawsuit was filed against Monsanto in a Los Angeles Superior Court, with base claims of the company’s falsely advertising that its popular weed killer was safe. Furthermore, the legal action asserts that Monsanto intentionally falsified documents and cloaked data that linked Roundup’s key ingredient glyphosate to serious human illness.
Roundup MDL Consolidates Lawsuits Against Bayer
As increasing numbers of plaintiffs filed Roundup lawsuits against Bayer, federal multidistrict litigation (MDL) was established (MDL No. 2741). This MDL consolidated the lawsuits in the Northern District of California, under U.S. District Judge Vince Chhabria. Under MDL, the pretrial proceedings—such as depositions, discovery, and decisions regarding questions of fact—for Roundup cases will be centralized, in the interest of consistency and efficiency. However, each individual case is addressed and decided separately, with regard to awarding damages, etc.
This means that you could recover a separate settlement or verdict even if you decide to join the ongoing litigation.
Impact of a Potential Settlement on Current and Future Cases
As of September 2019, there is no verified news of a planned settlement offer in the Roundup cancer lawsuits that have been filed so far. Both plaintiffs and defendant have yet to agree on a sum to set aside for future claimants. This is an important aspect of settling Bayer’s liability for its cancer-causing product, like many illnesses, non-Hodgkin’s lymphoma (the illness most frequently linked to Roundup and glyphosate) can take years to manifest in a patient.
Once all of the original MDL cases, as well as any tag-along cases, have been settled, tried, dismissed, or sent back to their district court, the MDL will be terminated.
If are unable to join the MDL, you may be able to file an individual lawsuit against Bayer AG. The team at the Law Offices of Anidjar & Levine can help.
