A rear-end crash has led to the death of a man in a car on I-75. An account of the events that played out was given by the police.
A Subaru Outback was forced to stop in traffic on Interstate 75 in North Miami when a driver of a big rig truck rammed failed to stop and rammed in the car from behind.
The driver of the truck was still traveling at such a high rate of speed that it caused the death of the driver of the Subaru upon impact. He was confirmed dead at the scene of the accident.
The truck partially rolled over the Subaru. This left the Outback wedged underneath the truck.
Because of the severity of this crash and the fact that there was a death to the car that was struck, the investigation is still ongoing and charges are pending. At this time we don’t know why the driver of the truck failed to stop. It was reported by the Florida Highway Patrol that the driver must have been distracted while behind the wheel.
Marc Anidjar, from the Law Firm of Anidjar & Levine, comments about this accident: “Rear-end accidents are one of the most dangerous kinds of accidents that can happen on our roadways. Often, when a person is rear-ended they are completely taken off-guard and have not had an opportunity to brace for an impact. Because rear-end accidents tend to be the result of distracted driving or following too closely on the part of the driver in the rear, the law presumes that the rear driver in a rear-end accident was at fault for the accident.
It is important to note that this is a rebuttable presumption, which simply means that a driver who is presumed to be at fault for an accident has an opportunity to present evidence that he or she was not negligent in causing the accident or that some other factors may exist that directs fault to someone or something else.”
